Recently featured in the Daily Mail, a family dispute over an £400,000 estate ended in court after an elderly woman changed her will following a falling-out with relatives. The disagreement stemmed from her great-nephew’s parents suggesting she move into a care home - a comment she found deeply offensive. Originally set to inherit under an older will, the great-nephew contested the new will, claiming lack of capacity, but the judge upheld the aunt’s final wishes. This case is a stark reminder of how sensitive family dynamics and unclear planning can lead to costly, emotional battles.
What could have been done differently?

✓ Early Communication – Families should have open, honest conversations about care needs and financial arrangements before tensions arise.

Rachel joined us last month as a Legal Director in our Employment Law team, bringing with her more than 20 years of specialist experience advising on the full range of workplace issues from dismissal and discrimination claims to redundancy, grievances, and Employment Tribunal matters. Her expertise spans both contentious and non-contentious work, including contracts, settlement agreements, and workplace policies.

She has represented clients across sectors such as the public sector and sports organisations, and is known for her strategic advice, sharp attention to detail, and pragmatic approach.

✍️ Thinking about writing a Will? Here are your FAQ's answer:

1️⃣ What happens to my estate if I do not make a Will? Without a valid Will, your assets are distributed by law—not by your wishes. Intestacy rules may mean loved ones or partners you intended to provide for receive nothing. Plus, your estate might face higher inheritance tax.

2️⃣ What do I need to think about before making a Will? Before your initial meeting, it is helpful if you consider the following:

- What you own (property, savings, belongings)
- Who you want to leave things to (family, friends, charities)
- Who should be your Executors (to carry out your wishes)
- Guardians for your children (if under 18)
- Whether you need trusts or tax planning

3️⃣ Will my estate have to pay Inheritance Tax when I die? You can pass on up to £325K tax-free, or up to £1M as a couple if your home goes to children/grandchildren. Business, farming, or leaving money to charity - you could reduce the tax further.

4️⃣ Can I stop someone from making a claim against my estate? Not completely - but you can take steps to protect it. If you’re excluding someone (like a former partner, child, or dependant), you can:

- Clearly state this in your Will
- Write a letter explaining why

This won’t prevent a claim, but it can help defend your wishes.
