Lasting Power of Attorney

A lot of people believe when they have made their Will they have done everything they can to protect their future.

Unfortunately, Dementia has overtaken Cancer as the highest cause of death and so making your Lasting Powers of Attorney (LPA) will prevent your family from future stress and extremely costly bills should they be required.

What is a Lasting Power of Attorney (LPA)?

LPA’s were created in English law under the Mental Capacity Act 2005 and came into effect in October 2007. The documents allow someone you appoint to act on your behalf should you no longer be able to. There are two types of LPA’s you need to legally provide full protection and cover: 'Health and Welfare' and 'Property and Financial Affairs'

Did you know the legal rights of unmarried couples are complicated!

Unfortunately, common law marriage does not exist and therefore regardless of how long you have lived together, or even if you have children together, should one of you pass away without a Will, you will not be entitled to anything. The law of intestacy does not take into account unmarried couples and with almost 15% of the population cohabiting, this is a lot of people that could be negatively affected if they do not prepare for the worst.

Is there a way to protect my children from disinheritance?

It isn't clear to a lot of people that marriage will void any previous Will made, allowing your new spouse to inherit everything. Even if your Will stated otherwise before you were married.

With this in mind, should your spouse survive you, there is nothing to stop them changing their Will after your passing and disinheriting your children from a previous relationship.

There is a way to ensure your blended family are protected and this is through a Trust. You can ensure you are providing for your spouse, whilst also protecting your children's inheritance and future. A Trust can also protect from any future marriages as well, ensuring you are looking ahead with a clear mind without being clouded by any grief.

What is an Executor?

Any Will made must name an Executor.
An Executor is then legally responsible for carrying out the instructions in the Will and handling their estate when they die (money, property, and possessions).

So, who can be an Executor?

You can act as an Executor as long as you are over the age of 18. It can be an individual and/or a professional, such as the directors of Legacy Direct Ltd.
You can be a beneficiary in the Will, a spouse or child of the person’s Will. There can be up to four Executors carrying out the responsibility together, but all decisions must be jointly made.
It is advised to have a minimum of two just in case one dies or is unable to carry out their duties.
