Being the non-EU family member of an EU citizen can give you rights under EU free movement law that do not simply begin when the French residence card is finally issued.
In practice, however, employers, institutions, airlines, border authorities and even administrative documents can sometimes create serious problems when a residence application is still pending.
This can affect your ability to:
🇫🇷 reside in France
💼 work legally
🏠 access housing and services
🏥 access social security
✈️ travel and cross the border
The legal framework includes Directive 2004/38/EC, the French CESEDA and CJEU case law, including MRAX, Metock and Zhu and Chen.
If you are currently experiencing a problem with your rights as the family member of an EU citizen, your situation may require more than simply waiting for the prefecture.
