À l’ère de Neuralink et des percées neurotechnologiques de Meta, les pensées deviennent des données — des schémas neuronaux décodés en stratégies, inventions ou créations, avant même qu’un mot ne soit prononcé.

Imaginez :
✅ Des interfaces cerveau-ordinateur (BCI) horodatent le moment exact où une idée jaillit dans votre esprit.
✅ Le cartographie cognitive par IA reconstitue la parole intérieure avec une précision impressionnante (les recherches de 2025 atteignent déjà environ 25 % de taux d’erreur de mots sur de larges vocabulaires).

Les premières avancées — comme le Colorado, qui a récemment classé les données neuronales parmi les informations sensibles — ne sont qu’un début.

Il nous faut :
🔹 Des textes de loi reconnaissant la valeur juridique des idées issues du cerveau
🔹 Des neurorights intégrés dans les législations (la vie privée mentale = liberté cognitive)
🔹 Des tribunaux spécialisés capables de trancher les litiges sans révéler les secrets de pensée

Si nous n’évoluons pas, l’innovation se fera pirater à la source : le cerveau humain.

In the age of Neuralink and Meta’s neurotech breakthroughs, thoughts are now data—neural patterns decoded into strategies, inventions, or designs before a word is ever spoken.

Picture this:
✅ BCI timestamps prove when an idea sparked in your brain.
✅ AI cognitive mapping reconstructs inner speech with stunning accuracy (2025 research already delivers ~25% word-error rates on large vocabularies).

No notebook. No email. Just verifiable proof of origin—without disclosure.

This is the dawn of neurocognitive trade secrets—a concept I introduced years ago to define commercially valuable ideas that exist only in the mind, pre-expression, and are now at risk of extraction via BCI.

Yet traditional IP law is not ready.

How we could protect thoughts today:
- Treat neural patterns as trade secrets under the UTSA or EU Directive 2016/943—confidential, economically valuable, secured by neurofirewalls (encrypted BCIs + consent locks).
- Use forensic neuro-evidence in sealed court proceedings.
- Patent the decoding tech, not the idea itself.
