EXCHANGE OF BRITISH DRIVING LICENSES IN SPAIN

From now on, holders of a valid and current driving license issued by in UK or Spain may request the exchange of their equivalent driving license where they have established their residence, without being subject to any additional requirement of practical test or theoretical and according to the equivalence tables between the categories of permits from both countries.

The agreement establishes that all valid permits or licenses of current residents issued prior to its entry into force may be exchanged, while for permits issued after said entry into force it will be an essential requirement to access the exchange that the permits have been issued in the country where the applicant had his legal residence.

With this pact, those British citizens residing in Spain who had not had their driving license recognized before Brexit, nor in the successive extensions granted, will be able to do so as of Thursday, March 16.

To facilitate administrative processing at the provincial traffic headquarters, a period of six months has been granted during which British citizens can circulate in Spain with their original permit while they process the exchange.

In addition, Spain and the United Kingdom undertake to provide each other with information on the data of the vehicles and their owners for the purpose of investigating traffic offenses related to road safety, especially in cases of speeding, not wearing a seat belt, failure to stop at a red light, driving while intoxicated, driving under the influence of drugs, not wearing a crash helmet, driving in a prohibited lane, or illegal use of mobile phones.

Sentencia del Tribunal Supremo nº 35/2021, de 27 de enero de 2021 resuelve sobre los efectos económicos de la declaración de nulidad de la cláusula de gastos de los préstamos hipotecarios entre bancos y consumidores. Esta doctrina supone que los consumidores tienen derecho a la restitución de todos los gastos pagados en concepto de registro de la propiedad, gestoría y tasación, así como de la mitad de los gastos notariales. Solo el Impuesto sobre Actos Jurídicos Documentados, en el que las normas tributarias establecen que el principal sujeto pasivo es el prestatario, corre a cargo de los consumidores.

NEW COVID-19 RESTRICTIONS: The Generalitat Valenciana approved the restrictions for Christmas, in force from today. The perimeter closure of the autonomous community and the curfew, from 23:00 to 6.00, are extended until the 15th of January with exceptions on Christmas Eve and New Year's Eve festivities in which mobility will be allowed until 12 am and the perimeter closure will continue.
The meetings during these five holidays are allowed only with 6 people. Although it is recommended that the meetings be between a maximum of two groups of cohabitants

The nightlife (nightclubs and discos) reopens, after four months closed, during daytime hours and only to provide hotel and restaurant services. Static Three Kings parades will only be allowed in places where access can be controlled or aboard transport vehicles, without being able to throw candy or objects.

New residence card for British citizens in Spain

Since 6th July there is a new residence process for British citizens and families: if you have your green card, we recommend you to change it.
If you have arrived to Spain after that day, you could request the residence trough this new process.

BREXIT: Residence in Spain
As of July 6, 2020, a new procedure will be established to obtain residence for British citizens in Spain.

Citizens who already have their residence, it is not mandatory to request a new residence document, since the registration certificates and cards of family members of EU citizens will serve to prove their legal residence in Spain later and benefit from the provisions of the Agreement of Withdrawal.

However, obtaining this residence document will facilitate the completion of administrative procedures and even the crossing of the external borders of the European Union.

For those who arrive in Spain after July 6, they will be processed as requests for the residence document of Article 18.4 of the Agreement.

Those arriving after January 1, 2021, will be subject to the general immigration regime, unless a future mobility scheme is negotiated within the framework of the Future Relationship Agreement that is being negotiated between the UK and the EU.

ACTUALIZACIÓN JULIO 2020: Ya no es necesaria la cuarentena y los viajeros pueden venir a España sin restricciones más allá de seguir las medidas de seguridad necesarias. No obstante, le recomendamos consultar en su consulado o embajada si su país de procedencia en concreto pudiera tener alguna restricción a la ida o a la vuelta.
CUARENTENA: Quedan exceptuados de estas medidas los trabajadores trasfronterizos, transportistas y las tripulaciones, así como los profesionales sanitarios que se dirijan a ejercer su actividad laboral, siempre que no hayan estado en contacto con personas diagnosticadas de COVID-19.
