A new success for our office!!
In May 2024, we submitted a digital nomad visa application to the UGE. Due to issues with electronic communications, the UGE decided to archive the application, which we disagreed with.

As a result, we filed an appeal, and although it took several months of waiting, it was determined that archiving the application was inappropriate, and our client has been granted residency.

***BRITISH CITIZENS WITH RESIDENCY AS BENEFICIARIES OF THE WITHDRAWAL AGREEMENT : YOU MUST RENEW YOUR RESIDENCY THIS YEAR *** ( Residency given on 2020)

Five years have passed since Brexit and those British citizens who obtained residency in Spain as beneficiaries of the withdrawal agreement have to renew it throughout this year.

WHEN DO I HAVE TO RENEW THE RESIDENCE DOCUMENT IDENTIFYING ME AS A BENEFICIARY OF THE AGREEMENT?

The Agreement beneficiary residence document must be renewed 30 days before the document is due to expire or within 90 days after the expiry date of the document.

If you had a registration certificate, you can request the issuance of a new residence document from the police offices that are authorised to issue it, which, after verifying the duration of residence, will issue it.

If, on the other hand, you do not have this previous certificate or card, the request will be addressed to the foreigners' office of the place where you reside, which, after assessing the request and, in the event of a positive decision, will allow you to request the issuance of the document

POSITIVE RESOLUTION FOR DIGITAL NOMAD VISA !!!

The UGE has granted our client the digital nomad visa that will allow her to live and telework in Spain for 3 years with her three daughters.
Our client was self-employed in the United States and now she will be able to continue working online from Castellon, where she lives.

REJECTED RESOLUTION : THE APPLICANT HAD NOT PROVIDED RELIABLE PROOF OF HIS STATUS AS A DEPENDENT OF THE BRITISH CITIZEN.

Unfortunately, positive resolutions are not always obtained.
In the present case our client Tammie was applying for ARTICLE 50 TEU FAMILY RESIDENCE FOR UNITED KINGDOM NATIONALS ARTICLE 18.4 OF THE RETIREMENT AGREEMENT) for her parents.

In the first application, the requested residence document was denied because the applicant had not provided reliable proof of his status as a dependent of the British citizen.

We filed an appeal arguing that dependency should not always be based on economic terms and justifying that in this case the dependency was based on health terms.

But the laws on foreigners are strict and if one of the requirements is not met, residence is denied. For health reasons Tammie's parents are dependent on her, they cannot return to the UK, but the immigration office, applying the strict criteria of dependency, has not considered this to be the case.

TIE ART. 50 TUE : WILL BE THE ONLY DOCUMENT THAT ALLOWS THE BENEFICIARIES OF THE WITHDRAWAL AGREEMENT TO BE EXEMPETED FROM THE ACCOUNTING OF THEIR TIME OF STAY IN THE ENTRY/ EXIT SYSTEM.

CHANGE YOUR GREEN CARD. With the forthcoming entry into operation of the new computerised EU external border crossing systems (Entry/Exit System; EES, expected in November 2024, and European Travel Information and Authorisation System; ETIAS in the first half of 2025) the foreign Identity Card (‘TIE art.50 TUE’) will be the only document that allows the beneficiaries of the Withdrawal
Agreement to be exempted from the accounting of their time of stay in the EES and the application for travel authorisation through ETIAS.

BRITISH CITIZENS : IF YOU HAVE AN IRISH PASSPORT YOU CAN OBTAIN THE SPANISH RESIDENCE AS EUROPEAN CITIZEN AND GIVE YOUR FAMILY THIS RESIDENCY TOO .

Yes, if you have an Irish passport you will be able to live in Spain as a resident and give the residence to your family members.
But for this you will have to register in Spain and obtain the Certificate of Registration of the European Union.

Once you obtain this certificate as an Irish resident in Spain, the family member you want to give the residence to will have to apply for the residence as a family member of an EU citizen as long as both of you have the requirements. In this case your family must to ask the residency in the foreing office where both are you living.
