What happens if your A1 Certificate can’t be extended under the Digital Nomad Visa?

We’ve been helping Wayne & Karen with their Spanish visas since 2021, and they’re now both living and working in Spain.

If your A1 can’t be extended, switching to a self-employed contract is often the solution, especially if your employer doesn’t want to pay Spanish social security.

With the right guidance, there’s always a solution.

Legal Services in Spain handled the Year 4 & 5 NLV renewal electronically for this Client as authorised legal representatives with the Oficina de Extranjería (Foreigners Office) in Granada.

Although the requirements were more stringent than the previous renewal, our experience and in-depth understanding of residency regulations ensured a successful approval.

As is often the case, the only consistency lies in the inconsistency of documentation requirements!

If you need help with your NLV renewal do contact our dedicated Residency Team at https://legalservicesinspain.com

𝐍𝐨𝐧-𝐋𝐮𝐜𝐫𝐚𝐭𝐢𝐯𝐞 𝐕𝐢𝐬𝐚 𝐋𝐞𝐠𝐢𝐬𝐥𝐚𝐭𝐢𝐨𝐧 – 𝐅𝐢𝐧𝐚𝐧𝐜𝐢𝐚𝐥 𝐑𝐞𝐪𝐮𝐢𝐫𝐞𝐦𝐞𝐧𝐭𝐬 𝐔𝐩𝐝𝐚𝐭𝐞

Recent developments at the Spanish Consulate in Manchester indicate a shift in the documentation required to demonstrate sufficient financial means for a non-lucrative visa. Previously, applicants were typically asked to provide just three months' worth of bank statements. However, the Consulate now appears to be requesting additional financial documentation as follows:

𝐔𝐩𝐝𝐚𝐭𝐞𝐝 𝐁𝐚𝐧𝐤 𝐬𝐭𝐚𝐭𝐞𝐦𝐞𝐧𝐭𝐬 𝐨𝐟 𝐥𝐚𝐬𝐭 𝟏𝟐 𝐦𝐨𝐧𝐭𝐡'𝐬 𝐬𝐭𝐚𝐦𝐩𝐞𝐝 𝐛𝐲 𝐭𝐡𝐞 𝐛𝐚𝐧𝐤, 𝐢𝐧𝐜𝐥𝐮𝐝𝐢𝐧𝐠 𝐜𝐞𝐫𝐭𝐢𝐟𝐢𝐜𝐚𝐭𝐞 𝐨𝐟 𝐚𝐜𝐜𝐨𝐮𝐧𝐭 𝐨𝐩𝐞𝐧𝐢𝐧𝐠 𝐝𝐞𝐭𝐚𝐢𝐥𝐬 𝐚𝐧𝐝 𝐚𝐮𝐭𝐡𝐨𝐫𝐢𝐬𝐞𝐝 𝐩𝐞𝐫𝐬𝐨𝐧𝐬.

In accordance with the legislation stamped UK bank statements must include:-

a) The full name or business name of the bank or credit institution, as well as its address.
b) The full identification of the accounts.
c) The opening or closing date
d) The account balances as of December 31 of the year prior to the year in which the application is submitted and the average balance for the previous year.

If you have been asked to provide updated bank statements following your initial visa application appointment, this is likely due to the Consulate now enforcing point (d) mentioned above.

𝐀𝐬 𝐚 𝐫𝐞𝐦𝐢𝐧𝐝𝐞𝐫, 𝐚𝐥𝐥 𝐢𝐧𝐜𝐨𝐦𝐢𝐧𝐠 𝐟𝐮𝐧𝐝𝐬 𝐦𝐮𝐬𝐭 𝐛𝐞 𝐟𝐮𝐥𝐥𝐲 𝐝𝐨𝐜𝐮𝐦𝐞𝐧𝐭𝐞𝐝, 𝐰𝐢𝐭𝐡 𝐚𝐩𝐩𝐫𝐨𝐩𝐫𝐢𝐚𝐭𝐞 𝐞𝐯𝐢𝐝𝐞𝐧𝐜𝐞 𝐭𝐨 𝐯𝐞𝐫𝐢𝐟𝐲 𝐭𝐡𝐞 𝐬𝐨𝐮𝐫𝐜𝐞 𝐨𝐟 𝐞𝐚𝐜𝐡 𝐩𝐚𝐲𝐦𝐞𝐧𝐭.

We would be happy to arrange a consultation at a mutually convenient time to discuss your circumstances in more detail and provide tailored advice.

💪 AGAINST ALL ODDS… WE DID IT! ✨

Last week, we had the pleasure of welcoming Tim & Efren to our office — and what a lovely surprise: they brought each of us a bottle of wine as a thank you to Melanie, Chiara, and Mercedes for their dedication and hard work! 🍷❤️

Tim & Efren had lived in Miami and dreamed of starting a new life in Spain through the Golden Visa. Their property purchase completed in August 2024, and everything was set for them to come to Spain so we could submit their Golden Visa applications electronically.

Then Hurricane Helene struck, flooding their town in Miami. We quickly adapted and applied for the one-year Golden Visa at the Spanish Consulate in Miami instead. When they finally made it to Spain in January 2025, they discovered their new Spanish home had also suffered flood damage. But despite it all, they stayed positive and kept moving forward! 🌊🏠✨

The next challenge: applying for the TIE residency card. Normally, this should be done within 90 days — but after so much disruption, we managed to get them an appointment five months later. On 9 July, Chiara personally accompanied them to the police station. If anyone could make it happen, it was Chiara… and she did! 🙌
A fantastic result, true teamwork, and proof that with determination (and the right support), anything is possible. 💙

𝗜𝗺𝗽𝗼𝗿𝘁𝗮𝗻𝘁 𝗨𝗽𝗱𝗮𝘁𝗲: 𝗩𝗮𝗹𝗶𝗱𝗶𝘁𝘆 𝗣𝗲𝗿𝗶𝗼𝗱 𝗡𝗼𝗻-𝗟𝘂𝗰𝗿𝗮𝘁𝗶𝘃𝗲 𝗩𝗶𝘀𝗮

Are you thinking about applying for Spain’s non-lucrative visa? There’s some very welcome news: once approved, the visa affixed in your passport now comes with a 365 day validity – no longer 3 months.

This change offers much more flexibility. Previously, if your move to Spain was delayed and the original 3-month window expired, you had to start the whole application process again. Now, with a full year of validity, you have extra time to finalize your plans without added stress.

Whether you're still organising your relocation or waiting for the perfect moment to move, this update gives you the breathing room you need.

It’s also a major advantage for those trying to coordinate the sale of a UK property with their visa timing. If, for example, your property sale gets delayed, you’ll now have a longer window to enter Spain—as long as you're not relying on those sale proceeds to meet the financial requirements of the visa.

A Few Important Reminders:

• Your residency clock starts ticking the day you enter Spain with your visa. That’s considered your official first day of residency.
• You’ll need to apply for your TIE card (foreigner ID card) within one month of arrival. While some delays are understandable, it’s best to stay on top of this step and complete it as soon as possible.

Preparation Still Matters -

Even with this added flexibility, getting your visa approved still comes down to accurate documentation, solid financial proof, and good timing. Working with a professional who specialises in Spanish visa applications can make the process smoother and more successful.

Melanie Radford, who heads up our residency department, shared in this weekend's The Times and The Sunday Times the legal situation in Spain for holders of the Golden Visa, after the removal of the Visa.

The initial authorisation is for 3 years and then renewable for periods of 5 years. At the five-year point you can apply for permanent residency, as long as you can prove you have consistently resided in Spain for five years.
