→ New housing measures published in Spain
Two Royal Decree-laws published in the Spanish Official Gazette on 7 October 2026 introduce significant changes for landlords, tenants, investors and owners of holiday lets.
Among the main measures:
🏠 Habitual residence leases: successive 5- or 7-year extensions once the minimum term has ended.
💶 Compensation for tenants when a landlord decides not to renew, subject to exceptions.
📅 Stricter rules for temporary and medium-term rentals.
🔑 Changes to agency fees, deposits, repairs and tenants’ preferential purchase rights.
🏖 10% VAT on furnished rentals of 30 nights or less from 1 December 2026, unless the property is the landlord’s main residence.
🧾 Non-resident owners of holiday lets may need to register for Spanish VAT.
🏡 Higher deemed income tax on second homes from 2027.
The measures take effect on different dates, and both Royal Decree-laws remain subject to parliamentary ratification.
