BRITISH TIE HOLDERS HAVING TO WAIT FOR EXPIRY DATE

The fact that British citizens that didnt held green card previously to TIE under Withdrawal Agreement have to wait for expiry date + 1 day to renew to permanent has got nothing to do with Brexit.

A. EUROPEANS
An european citizen once reaches 5 years they renew their green card by proving they have fullfilled, and carry on doing, the requirements for residency in Spain. But can only do this once they have reached 5 years + 1 day from when the temporary green card was issued. If they go in on 5 years or.before they would not get permanent but a 5 years duplicate.

B. NON EUROPEANS
Non europeans citizens that hold a temporary residency and are going to renew or become permanent can start the process of renewal at the immigration side 60 days (30 days for non european family member of an european) before expiry date. Normally immigration answers after those days but in some cases they answer before the 60 days and therefore before expiry date. If this happens -you get renewal approval or permanent approval quick- and try and go and get fingerprints they WILL NOT LET THEM PROCEED. Why? Because they have to wait -as the approval says- until the day after expiry date which is.when the approval starts counting.

C. BRITHISH UNDER WITHDRAWAL AGREEMENT
British under WA are as in european regime therefore dont need to send in a application to immigration to renew they just go to police and get the card renewed. It would be a green card but they changed it to TIE and on the appointment day they dont get checked any renewal requirements as europeans and non europeans (as WA states so) but they DO HAVE TO WAIT same as europeans and non europeans for their expiry date + 1 day as that is when they have been really 5 years resident and the permanent status starts.
This is why British that had Green card before dont need to wait for expiry of the tie card because the permanent residency is already obtained and already in the system so.the system issues permanent tie card


Once the tie cards are permanent and need to renew every 10 years (majority 2030 onwards) British will not need to wait for expiry date same as non europeans dont when permanent as the status is not changing its only renewing the card. And will be able to renew 60 days before.expiry date.

Hope this makes it a bit more crear for you that is not against British and immigration and police offices are not making up new rules at all. 😊

WITHDRAWAL AGREEMENT RENEWALS

British nationals that have only had TIE resident card and didnt have green card before can renew automatically at the national police doing fingerprints

IMPORTANT. It has to be earliest the day after expiry date of not it Will not be done for not being resident for 5 years.
I have done the first renewal in Mallorca today so this is 100% how the process will be all over Spain.

RENOVACIONES ACUERDO DE RETIRADA

Los británicos que tienen sólo TIE y nunca han tenido tarjeta verde anterior pueden renovar a permanente haciendo huellas directamente en policía nacional.

IMPORTANTE. Lo más pronto que se puede ir a hacer huellas es el día después de la caducidad de la tarjeta TIE.

Hoy he hecho la primera renovación en Mallorca y este será 100% el procedimiento a seguir a nivel nacional.

VERY IMPORTANT INFORMATION.

I have been contacting my clientes with this information to get the correct cards and want to share with all of you.

If you are British national resident in Spain under withdrawal agreement :

- you had a Green card
or
- you have been accepted through immigration application EX20 under withdrawal agreement

and your TIE card states same wording as in the picture I have shared, be aware you need to change your TIE card.

The wording options on the front side for British under withdrawal agreement can only be:
1) temporal
Artículo 50 TUE

2) permanente
Artículo 50 TUE

If your renewal to permanent is near you can wait until then but you have the right to change It inmediatley.

This has happened because the immigration system had a failure in the cards system during some weeks.

"Quarter. Issuance of the residence document provided for in article 18.4 to United Kingdom nationals residing in Spain in accordance with the conditions established in the Agreement.
1. Nationals of the United Kingdom residing in Spain in accordance with the conditions established in the Agreement may request, in accordance with the provisions of article 18.4 thereof, the issuance of a residence document. This residence document will be issued in accordance with the uniform residence permit model for third-country nationals provided for in Regulation EC No.1030/2002 corresponding to type of permit and in Observations, the following phrase “issued in accordance with article 18.4 of the Withdrawal Agreement” must be included."

PLEASE TAKE INTO ACCOUNT THIS IS ONLY APPLICABLE TO BRITISH NATIONALS UNDER WITHDRAWAL AGREEMENT.

Cápsula informativa: "Cuando una persona extranjera se plantea vivir en España ¿Qué aspectos crees que debe tener en cuenta antes de iniciar los trámites para venir para acá?"

No podía ser otro aspecto que el más importante de tener en consideración la nacionalidad y con ella la necesidad o no de visado (ya no sólo como turista sino y más importante para entrar como residente si esa es la intención).

Aún más importante para los británicos que ahora han entrado en el sistema del régimen extracomunitario, muy nuevo para ellos.

Informative Capsule: "When a foreign person considers living in Spain, what aspects do you think they should take into account before starting the procedures to come here? "

The answer couldnt be about another aspect that taking into account the nationality and with It the need or not to get a visa (not only as a tourist but more important to enter as a resident if that is the final intention)

It is even more important for British nationals that now have entered the system for non european citizens, very new for them.

SOIB INFORMATION REGARDING BRITISH NATIONALS RESIDENTS IN SPAIN

Most of you have received an email from the SOIB office in relation with your resident card and the date of 31/12/2021

This email DOES NOT SAY that the ones of you that hold a green card you are obliged to change to TIE before this date. Also if you have received this information from them on the phone IT IS NOT THE CORRECT EXPLANATION.

ALL of the British nationals residents in Spain that are active on the SOIB system need to send to their email a scan or photo of their Green card or tie cards.
THE REASON? British citizens as you know are now non european citizens so the SoIB system has had to enter an expiry date (existent always for non europeans citizens) which they dont have in the system as the green ones do not have one.
Therefore they have uploaded a general expiry date of.31/12/2021 and are now asking everybody related.to SOIB system to please send Green resident card or tie.

If your Green card is.temporary they Will add 5 years from when It was issued and if permanent they Will add 10 years. For ties they Will add the expiry date the card already has.

And yes there will be some situations of Green cards holders that adding the new date of expiry (5 years or 10 years) It Will be needed for them to renew and therefore get a tie but because the Green ones are not issued anymore and that situation needed renewal and not because there is the new date that everybody is obliged to exchange to tie.

Also I just want to add that social security office and SEPE Office for internal reasons are not accepting any Green cards issued previous to april 2012.
