BRITISH TIE HOLDERS HAVING TO WAIT FOR EXPIRY DATE
The fact that British citizens that didnt held green card previously to TIE under Withdrawal Agreement have to wait for expiry date + 1 day to renew to permanent has got nothing to do with Brexit.
A. EUROPEANS
An european citizen once reaches 5 years they renew their green card by proving they have fullfilled, and carry on doing, the requirements for residency in Spain. But can only do this once they have reached 5 years + 1 day from when the temporary green card was issued. If they go in on 5 years or.before they would not get permanent but a 5 years duplicate.
B. NON EUROPEANS
Non europeans citizens that hold a temporary residency and are going to renew or become permanent can start the process of renewal at the immigration side 60 days (30 days for non european family member of an european) before expiry date. Normally immigration answers after those days but in some cases they answer before the 60 days and therefore before expiry date. If this happens -you get renewal approval or permanent approval quick- and try and go and get fingerprints they WILL NOT LET THEM PROCEED. Why? Because they have to wait -as the approval says- until the day after expiry date which is.when the approval starts counting.
C. BRITHISH UNDER WITHDRAWAL AGREEMENT
British under WA are as in european regime therefore dont need to send in a application to immigration to renew they just go to police and get the card renewed. It would be a green card but they changed it to TIE and on the appointment day they dont get checked any renewal requirements as europeans and non europeans (as WA states so) but they DO HAVE TO WAIT same as europeans and non europeans for their expiry date + 1 day as that is when they have been really 5 years resident and the permanent status starts.
This is why British that had Green card before dont need to wait for expiry of the tie card because the permanent residency is already obtained and already in the system so.the system issues permanent tie card
Once the tie cards are permanent and need to renew every 10 years (majority 2030 onwards) British will not need to wait for expiry date same as non europeans dont when permanent as the status is not changing its only renewing the card. And will be able to renew 60 days before.expiry date.
