⚠️Desaparición de las personas durante un largo periodo de tiempo🤔
El ordenamiento jurídico español contempla diferentes situaciones para regular su estado civil y administrar sus relaciones jurídicas y patrimonio.
1. La mera desaparición
Se produce cuando una persona está ausente y es necesario actuar en su nombre para gestionar asuntos personales o jurídicos. En estos casos, un juez puede nombrar un defensor que se encargue de su representación en juicio y de los intereses que no puedan esperar su vuelta.
2. La ausencia legal
Puede declararse cuando ha transcurrido un año desde la desaparición, o tres años si la persona dejó a alguien con poder para administrar sus bienes, sin que se tengan noticias de ella. Se nombra judicialmente a un representante encargado de descubrir el paradero del ausente y la administración de sus bienes.
3. La declaración de fallecimiento
Mediante resolución judicial, puede declararse el fallecimiento, con la extinción de personalidad jurídica con los mismos efectos que los del fallecimiento, cuando concurren los supuestos previstos en el Código Civil, como el transcurso de determinados plazos o la desaparición en circunstancias de especial riesgo o peligro de muerte.

Spanish law provides different legal mechanisms to regulate a person's legal status and to manage their legal affairs and assets when they have been missing for an extended period.
1. Mere Disappearance
This occurs when a person is absent and it is necessary to act on their behalf to deal with personal or legal matters. In such cases, a court may appoint a legal representative to represent the missing person in legal proceedings and protect any interests that cannot await their return.
2. Legal Absence
A declaration of legal absence may be made after one year has passed without any news of the missing person, or after three years if they had granted someone authority to manage their assets. The court appoints a representative responsible for trying to determine the missing person's whereabouts and managing their property.
3. Declaration of Death
By court order, a person may be legally declared deceased—with the same legal effects as death and the extinction of their legal personality—when the circumstances established by the Spanish Civil Code are met. These include the passage of certain statutory time periods or disappearance in situations involving a high risk or danger of death.
