Drug Trafficking Under Egyptian Law:
Legal Framework and Criminal Penalties
Drug trafficking is regarded as one of the most serious criminal offenses under Egyptian law due to its significant impact on public safety, national security, and social stability. Recognizing the grave consequences of this crime, the Egyptian legislature has established a comprehensive legal framework imposing severe criminal sanctions on individuals involved in the production, importation, distribution, or trafficking of narcotic substances.
The principal legislation governing these offenses is Law No. 182 of 1960 on Combating Narcotic Drugs and Regulating Their Use and Trafficking, as amended. The law clearly distinguishes between offenses such as personal consumption, possession, trafficking, importation, and manufacture, with each offense carrying distinct legal consequences depending on the facts, evidence, and criminal intent established before the competent court.
Under Egyptian law, drug trafficking generally refers to any activity involving the sale, distribution, transportation, promotion, or possession of narcotic substances for commercial purposes or financial gain. Whether a particular act constitutes trafficking is determined by the Public Prosecution and, ultimately, by the competent criminal court after assessing all evidence presented during the proceedings.
Criminal Penalties
Pursuant to Article 34 of Law No. 182 of 1960, drug trafficking may be punishable by life imprisonment or the death penalty, together with a criminal fine ranging from EGP 100,000 to EGP 500,000, in addition to the confiscation of narcotic substances, criminal proceeds, and any equipment or instruments used in the commission of the offense, where the statutory conditions are satisfied.
The applicable penalty may be further aggravated in circumstances expressly provided by law, including offenses involving the importation or manufacture of narcotic substances, participation in organized criminal activities, or other legally recognized aggravating factors.
A Fundamental Principle of Criminal Justice
It is essential to recognize that possession of narcotic substances does not automatically constitute drug trafficking. Egyptian criminal law draws a clear legal distinction between personal use, possession, custody, and trafficking, and the legal classification depends upon the specific facts of each case and the prosecution's ability to establish the required criminal intent.
Furthermore, every individual accused of a criminal offense is entitled to the constitutional presumption of innocence and remains innocent until proven guilty by a final and binding judicial decision rendered by a competent court.
Drug-related criminal proceedings frequently involve complex legal and procedural issues, including the legality of arrest and search procedures, the admissibility of evidence, forensic laboratory analyses, police investigations, and witness testimony. Careful legal assessment of these elements is often decisive in determining both criminal liability and the applicable legal consequences.
