التحقيق الصحفي الذي أعدّه الصحفي القدير الأستاذ سمير حسني بجريدة اليوم السابع كان أكثر من رائع، لأنه تناول بعمق قضايا النصب الرومانسي التي عايشتها في عملي كمحامٍ وشهدت آثارها على الضحايا. هذه الجرائم لا تقتصر على الاحتيال المالي، بل تمتد لتدمير الثقة وتشويه معنى العلاقة الإنسانية.
إن الجهد الصحفي المبذول هنا يستحق كل التقدير، فهو يفتح أعين المجتمع على خطورة الاستغلال العاطفي، ويؤكد أن المعرفة والوعي هما خط الدفاع الأول ضد هذا النوع من الجرائم.

Before You Pay a Down Payment… Make Sure the Project Is Licensed

Egyptian law prohibits advertising or selling residential units in any project that has not obtained a building permit.
Advertising an unlicensed project or collecting down payments exposes the developer to legal liability.

In addition, delayed delivery or handing over a unit that does not match the agreed specifications preserves the buyer’s legal rights, including the right to claim compensation or terminate the contract, and recently the developer shall face the jail for such actions.

Tip: Do not rely on advertisements or verbal promises. Always ask to see the building permit before making any payment.

A license is not just paperwork… it’s protection for your money.

قبل ما تدفع مقدم شقة… تأكد إن المشروع مرخّص

القانون المصري يمنع الإعلان أو بيع وحدات في مشروع لم يصدر له ترخيص بناء.
الإعلان عن مشروع غير مرخّص أو تحصيل مقدمات عليه يُعرّض المطور للمساءلة القانونية.

كمان، تأخير تسليم الشقة أو تسليمها بمواصفات مختلفة عن المتفق عليها حقك فيه محفوظ قانونًا، ويجوز لك المطالبة بالتعويض أو فسخ العقد ومؤخرًا المطور يعاقب علي الأعمال اللي تم الاشاره اليها وسينتهي بالمطور الأمر بالسجن

نصيحة: لا تعتمد على الإعلان أو الكلام الشفهي، واطلب دائمًا ترخيص البناء قبل أي دفع.

إن حقوق العباد لا تُسترد بالقوة وحدها، ولا تُنال بالحيلة أو المراوغة، وإنما تُستعاد بالسعي الصادق، واليقين الراسخ، والإيمان العميق بأن الله عز وجل هو الحكم العدل، الذي لا يضيع عنده حق ولا يغيب عن علمه مظلمة. فمن طرق أبواب الحق متوكلاً على الله، وجدها تُفتح أمامه، ومن صبر على الطريق، رأى العدل يتجلى نوراً يبدد ظلام الباطل

The rights of people are not reclaimed by force alone, nor attained through trickery or deceit. They are restored through sincere effort, steadfast conviction, and deep faith that Allah, the Almighty, is the Just Judge who never lets a right be lost nor a grievance go unnoticed. Whoever knocks on the doors of justice with trust in Allah will find them opened before him, and whoever endures along the path will witness justice shining as a light that dispels the darkness of falsehood.

المحاماة بين الأمانة والابتذال

المحاماة ليست سلعة تُباع في الأسواق، ولا حرفة تُؤدى بيدٍ غليظةٍ لا تعرف غير التكرار، بل هي فنٌّ رفيع، ورسالةٌ مقدّسة، وأمانةٌ ثقيلة لا يحملها إلا من طهرت سريرته، وسمت همّته، وارتقى بفكره.

المحامي الحقّ هو من يجعل من قلمه سيفاً، ومن لسانه درعاً، ومن ضميره ميزاناً، فلا يبيع الحقّ بثمنٍ بخس، ولا يساوم على العدل، ولا يستبيح مالاً ليس له بحق. فإن فعل، فقد خان الرسالة، وبدّد الأمانة، وكان كالصانع الذي يطرق الحديد بلا روح، بينما المحاماة لا تُطرق ولا تُصنع، بل تُبدع وتُجسّد، فهي لوحات من الفكر، وألحان من المنطق، وأشعار من العدالة.

وما أعظم الفرق بين من يزاولها كحرفةٍ ميّتة، وبين من يحييها كفنٍّ خالد؛ فالأول يكدّ كدّ الآلة، والثاني يبدع إبداع الفنان، يلون دفوعه بألوان البلاغة، ويصوغ حججه كقصيدةٍ تُطرب القلوب قبل أن تُقنع العقول.

فيا من ارتضيت أن تكون محامياً، اعلم أنّك لم تُخلق لتكون تاجراً في سوقٍ يبيع ويشتري، بل لتكون فارساً في ميدان الحق، تُقاتل بالبيان، وتنتصر بالحجة، وتُقيم ميزان العدل حيث اختلّ، وتُعيد الحقوق إلى أصحابها حيث سُلبت.

Advocacy Between Integrity and Degradation

Advocacy is not a commodity to be sold in markets, nor a craft performed by coarse hands repeating without thought. It is a noble art, a sacred mission, and a heavy trust borne only by those whose conscience is pure, whose resolve is high, and whose intellect is refined.

The true advocate is one who makes of his pen a sword, of his tongue a shield, and of his conscience a scale of justice. He does not sell truth for a paltry price, nor bargain with justice, nor seize wealth to which he has no right. Should he do so, he betrays the mission, squanders the trust, and becomes like a craftsman hammering iron without spirit. For advocacy is not forged nor manufactured—it is created and embodied; it is canvases of thought, melodies of reason, and verses of justice.

How vast the difference between one who practices it as a lifeless trade, and one who revives it as an immortal art. The former labors like a machine, while the latter creates like an artist—painting his arguments with colors of eloquence, composing his pleas like poetry that stirs hearts before it convinces minds.

So, you who have chosen to be an advocate, know that you were not made to be a merchant in a marketplace of buying and selling. You were made to be a knight in the arena of truth—fighting with words, triumphing with reason, restoring balance where justice falters, and returning rights to those from whom they were taken.

Have you purchased a residential unit or are you about to buy one? Do you worry that the unit you intend to purchase, or have already purchased, might be sold again to someone else?

Many buyers raise this concern, wondering what steps they should take to protect their property—whether it is an apartment, a villa, or a plot of land—from any encroachment that may occur after purchase and before completing the final registration.

It is common for the purchase to be made through a preliminary sale contract and a power of attorney authorizing disposal. However, ownership does not transfer until final registration, which is done by registering the sale contract at the Real Estate Registration Office, either voluntarily or through litigation by filing a lawsuit for validation and enforcement of the contract. Jurisprudence and law, as confirmed by the Court of Cassation, have established that ownership only transfers upon registration, and under the Civil Code, the seller’s acts remain valid against the buyer or third parties.

This raises the question: can the seller resell the property you purchased under a sale contract and power of attorney?
The answer is yes. The seller can resell the property as long as the contract has not been registered, because he remains the legal owner until registration.

But does this resale constitute fraud punishable under Article 336 of the Penal Code? The answer is no. For the crime of fraud by selling another’s property to exist, two conditions must be met: first, that the disposer does not have the right to dispose of the property; and second, that the property disposed of is not owned by him. In the case of resale, the seller is still the legal owner of the property, so the crime does not apply.

Therefore, if someone sells a residential unit to one buyer and then resells it to another, he is not committing fraud. The priority in such cases is always given to the buyer who first registers his contract definitively at the Real Estate Registration Office.

In conclusion, a preliminary contract or power of attorney is not sufficient to transfer or fully protect ownership. The only way to secure your rights is to promptly register the sale contract at the Real Estate Registration Office, as registration alone grants the buyer legal
ownership and shields the property from any subsequent resale.

Therefore before we buy a property in egypt we should ask a lawyer first to review the ownership and to make sure that we will be able to register the property, we shouldn’t follow the seller or the real estate agent or broker in whatever they might tell or say to us , we also need to
Draft the sale contract by a specialist lawyer in civil law “ this is very important point - don’t ask a criminal lawyer or a family lawyer to draft your contract “ which can protect us from selling the property once again by the previous owner plus taking the legal action to protects our property until we finial register the property in our name .
