معلومه قانونيه عن حالات القبض الباطل :
===============

١- اذا تم القبض علي شخص بأمر من النيابة العامة انتهت مدته ( أمر النيابة بالقبض يكون له مدة محددة به ٢٤ ساعة أو ٤٨ ساعة أو ..... ) .

٢- اذا كان أمر الضبط والاحضار صادر من نيابة غير مختصة .

٣- اذا كان أمر الضبط والاحضار غير موقع ممن أصدره أو غير مختوم بخاتم شعار الجمهورية أو أن الاسم الموجود به خطأ أو أن تاريخه غير مكتوب به أو أن أسم وكيل النيابة الذى أصدره غير مكتوب .

٤- اذا تم القبض خارج منطقة الاختصاص ولم يتم عرض المتهم على النيابة المختصة أو الإحالة للنيابة المختصة .

٥- اذا تم القبض أو التفتيش من مندوب شرطة أو عسكري لأن ليس من سلطتهم القبض على المتهم أو تفتيشه لأنهما من رجال السلطة العامة وليسا ممن يحمل صفة الضبطية القضائية .
