YOA’s Founder and Managing Director, Dr. Yasser OMAR AMINE, was invited by 𝐅𝐫𝐚𝐧𝐜𝐞 𝟐𝟒 to take part in the cultural program “Culture”, where he discussed his fourth book entitled: “𝑰𝒔𝒔𝒖𝒆𝒔 𝒐𝒇 𝒕𝒉𝒆 𝑽𝒊𝒔𝒖𝒂𝒍 𝑨𝒓𝒕 𝑴𝒂𝒓𝒌𝒆𝒕: 𝑰𝒏𝒔𝒑𝒊𝒓𝒆𝒅 𝒃𝒚 𝒕𝒉𝒆 𝑨𝒓𝒕 𝑴𝒂𝒓𝒌𝒆𝒕 𝒂𝒏𝒅 𝒕𝒉𝒆 𝑰𝒏𝒕𝒆𝒍𝒍𝒆𝒄𝒕𝒖𝒂𝒍 𝑷𝒓𝒐𝒑𝒆𝒓𝒕𝒚 𝑾𝒐𝒓𝒍𝒅𝒔”, published by AR Group (Cairo), 2021, 320 + XIV p.
During this in-depth interview, Dr. Amine addressed a range of legal challenges affecting the 𝐯𝐢𝐬𝐮𝐚𝐥 𝐚𝐫𝐭 𝐦𝐚𝐫𝐤𝐞𝐭 𝐢𝐧 𝐄𝐠𝐲𝐩𝐭 and the 𝐌𝐢𝐝𝐝𝐥𝐞 𝐄𝐚𝐬𝐭, at a time when artistic disputes have increasingly revealed the limits of purely aesthetic or critical approaches, with particular emphasis on:
– The emergence of 𝐀𝐫𝐭 𝐌𝐚𝐫𝐤𝐞𝐭 𝐋𝐚𝐰 as a distinct legal field in the Arab region
– The functioning of the art market and the need for a coherent legal framework governing its practices
– Protection of artists’ moral and economic rights
– The lack of legal awareness among artists, heirs, and art market professionals
– The role of law in regulating art transactions, galleries, auctions, and collections
The interview also addressed key legal issues examined in the book, including:
– Inspiration, imitation, and originality criteria
– Legal boundaries of artistic inspiration
– Sculptural editions, posthumous casting, and artists’ moral rights
– Artists’ contractual relationships with galleries and collectors
– Catalogues raisonnés, authentication methods, and provenance
– Forgery, attribution, and disputed artworks
Overall, the discussion underscored the growing intersection between 𝐢𝐧𝐭𝐞𝐥𝐥𝐞𝐜𝐭𝐮𝐚𝐥 𝐩𝐫𝐨𝐩𝐞𝐫𝐭𝐲 𝐥𝐚𝐰 and the 𝐚𝐫𝐭 𝐰𝐨𝐫𝐥𝐝, shedding light on practical legal disputes drawn from real market experiences and examined in the book through doctrinal analysis, case law, and applied perspectives.
Drawing on 22 analytical case studies, comparative jurisprudence, and art market practices, Dr. Amine’s book contributes to the development of an emerging legal discourse aimed at structuring art market practices and addressing long-standing legal gaps affecting artists, collectors, galleries, museums, and art market professionals.
YOA Law Firm is committed to shaping the future of 𝐀𝐫𝐭 𝐌𝐚𝐫𝐤𝐞𝐭 𝐋𝐚𝐰 in Egypt and across the MENA region, strengthening legal frameworks governing art market practices, and responding to the region's growing demand for expertise in 𝐀𝐫𝐭 𝐋𝐚𝐰 and 𝐈𝐧𝐭𝐞𝐥𝐥𝐞𝐜𝐭𝐮𝐚𝐥 𝐏𝐫𝐨𝐩𝐞𝐫𝐭𝐲.
