Dr. Yasser OMAR AMINE’s contribution to the 𝐚𝐧𝐧𝐮𝐚𝐥 𝐜𝐚𝐬𝐞 𝐥𝐚𝐰 𝐜𝐡𝐫𝐨𝐧𝐢𝐜𝐥𝐞 has been published in issue no. 5 of the French Industrial Property Journal « 𝑷𝒓𝒐𝒑𝒓𝒊𝒆́𝒕𝒆́ 𝑰𝒏𝒅𝒖𝒔𝒕𝒓𝒊𝒆𝒍𝒍𝒆 » (LexisNexis, May 2025, pp. 28-34).

In this chronicle, Dr. Amine provides a commentary on two significant and previously unpublished Egyptian rulings in trademark law:
• a ruling of the Beni Suef Economic Court dated 28 February 2024, and
• a ruling of the Administrative Judicial Court dated 25 May 2024.

Both decisions address key procedural and substantive issues in Egyptian trademark litigation. Dr. Amine examined the applicability of Law No. 7/2000 establishing conciliation committees for disputes involving ministries and public bodies to trademark matters and the procedural scope and appeal mechanisms under the Egyptian Intellectual Property Code. He also addresses the legal qualification of trademark infringement and the criteria for assessing similarities between marks, shedding light on judicial methods used to determine likelihood of confusion and protect distinctive signs.

Dr. Amine contributes to this annual chronicle, edited by Maître Laurier Yvon NGOMBE, alongside a distinguished team of intellectual property experts — both academic and practitioners — from France and beyond, actively promoting and advancing IP law across Africa and internationally through peer-reviewed academic publications in leading specialized journals.

Dr. Amine delved into detailed analysis of the high-profile case of Russian painter Georgy Kurasov vs. the Egyptian graphic designer Ghada Wali concerning the illegal reproduction of his paintings. In this case, the 3rd Misdemeanors Appeals Chamber of the Cairo Economic Court sentenced the Egyptian graphic designer to a 10,000 EGP fine for copyright infringement on June 9, 2024 (overturning the six-month imprisonment sentence).

The case is an opportunity to define the critical fine lines between counterfeiting and inspiration in the art world, as well as to tackle the challenges that are faced on assessing “originality” criteria and copyright infringement in art. Dr. Amine also addresses the proper methods of identifying the counterfeiting in disputed paintings inspired by characteristic elements of Pharaonic art.
