🟥 Human rights organizations call for lifting 10-year travel ban on Hoda Abdel Wahab

Egypt: Lift Travel Ban imposed on Hoda Abdel wahab ten years ago

The undersigned organisations call on the Egyptian authorities to immediately lift the travel ban imposed ten years ago on Egyptian lawyer Hoda Abdel wahab, in connection with Case 173/2011 and to ensure that all human rights defenders and civil society actors can exercise their right to freedom of movement without arbitrary restrictions or prolonged administrative uncertainty.

Hoda Abdelwahab is an Egyptian lawyer and the Executive Director of the Arab Centre for Independence of Judiciary and the Legal Profession (ACIJLP), a regional organisation established in 1997 that works to promote judicial independence, the rule of law, and respect for human rights across Egypt and the Arab region.

ACIJLP was among the NGOs investigated in Case 173/2011, known as the “foreign funding” case targeting NGOs in Egypt in late 2011. In December 2011, police and public prosecution officials searched the organisation’s offices and seized computers and documents from the premises.

On 20 June 2016, as she was departing to Oslo to participate in an international conference on the death penalty, Abdelwahab was informed at Cairo International Airport that a travel ban had been imposed on her by judicial order. She was never formally notified of this order and believes it is linked to Case 173/2011, which was reopened in 2016.

In March 2024, after 13 years of investigations – and three days following the declaration of the EU–Egypt strategic partnership agreement- the Egyptian authorities officially announced the closure of Case 173/2011. The investigating judge confirmed the completion of all investigations assigned to him concerning the remaining Egyptian civil society organizations in the case.

However, Abdelwahab remains the only human rights defender still subject to the travel ban imposed in 2016 in connection with Case 173/2011, after the authorities lifted the travel ban on her colleague Nasser Amin in December 2024. The travel ban on Hoda Abdelwahab has now been in effect for more than 10 years.

She continues to face restrictions without formal notification or clear legal reasoning, despite repeated attempts to clarify her status, including submitting pleas and complaints to the criminal court and the Public Prosecution office. The authorities have provided only unclear responses to her requests and have not officially removed her from the case file, which remains pending before the Supreme State Security Prosecution.

Travel bans continue to be used in Egypt as a tool to restrict the movement of human rights defenders, NGO workers, lawyers, and former detainees, often without due process or formal notification.

The undersigned organisations call on the Egyptian authorities to immediately:

Lift the arbitrary travel ban imposed on Hoda Abdelwahab as well as similar restrictions targeting human rights defenders and civil society actors;

Provide clear legal clarification regarding Abdelwahab’s status in Case 173/2011, particularly in light of the official closure of the case;

Acknowledge that ACIJLP was neither referred to trial nor formally investigated, and that the closure of Case 173/2011 confirms that there are no grounds for criminal proceedings;

Provide reparations for the prolonged restrictions Hoda Abdelwahab has faced due to the arbitrary travel ban and related measures;

Guarantee the protection of civil society and human rights defenders so they can operate without fear of intimidation, judicial harassment, or restrictions.

منظمات حقوقية تدعو لرفع حظر السفر المفروض على هدى عبد الوهاب منذ عشر سنوات

تدعو المنظمات الموقّعة أدناه السلطات المصرية إلى الرفع الفوري لحظر السفر المفروض منذ عشر سنوات على المحامية المصرية هدى عبد الوهاب، على خلفية القضية رقم 173 لسنة 2011، وضمان تمكّن جميع المدافعين عن حقوق الإنسان وأفراد المجتمع المدني من ممارسة حقهم في حرية التنقل دون قيود تعسفية أو إجراءات إدارية مطوّلة وغير واضحة.

هدى عبد الوهاب هي محامية مصرية والمديرة التنفيذية للمركز العربي لاستقلال القضاء والمحاماة (ACIJLP)، وهو منظمة إقليمية تأسست عام 1997 وتعمل على تعزيز استقلال القضاء وسيادة القانون واحترام حقوق الإنسان في مصر والمنطقة العربية.

وكان المركز العربي لاستقلال القضاء والمحاماة من بين المنظمات غير الحكومية التي خضعت للتحقيق في القضية رقم 173 لسنة 2011، المعروفة بقضية «التمويل الأجنبي» التي استهدفت المنظمات غير الحكومية في مصر في أواخر عام 2011. وفي ديسمبر/كانون الأول 2011، قامت الشرطة ومسؤولو النيابة العامة بتفتيش مكاتب المنظمة وصادروا أجهزة كمبيوتر ووثائق من مقرها.

وفي 20 يونيو/حزيران 2016، وأثناء مغادرتها إلى أوسلو للمشاركة في مؤتمر دولي حول عقوبة الإعدام، أُبلغت عبد الوهاب في مطار القاهرة الدولي بفرض حظر سفر عليها بموجب أمر قضائي. ولم يتم إخطارها رسميًا بهذا القرار مطلقًا، وتعتقد أنه مرتبط بالقضية رقم 173 لسنة 2011 التي أعيد فتحها عام 2016.

وفي مارس/آذار 2024، وبعد 13 عامًا من التحقيقات، وبعد ثلاثة أيام من إعلان اتفاق الشراكة الاستراتيجية بين الاتحاد الأوروبي ومصر، أعلنت السلطات المصرية رسميًا إغلاق القضية رقم 173 لسنة 2011. وأكد قاضي التحقيق استكمال جميع التحقيقات الموكلة إليه والمتعلقة ببقية منظمات المجتمع المدني المصرية في القضية.

ومع ذلك، لا تزال عبد الوهاب المدافعة الوحيدة عن حقوق الإنسان الخاضعة لحظر السفر المفروض عام 2016 على خلفية القضية رقم 173 لسنة 2011، وذلك بعد أن رفعت السلطات حظر السفر عن زميلها ناصر أمين في ديسمبر/كانون الأول 2024. وقد ظل حظر السفر المفروض على هدى عبد الوهاب ساريًا الآن لأكثر من عشر سنوات.

ولا تزال تواجه قيودًا دون إخطار رسمي أو مبررات قانونية واضحة، رغم محاولاتها المتكررة لتوضيح وضعها القانوني، بما في ذلك تقديم تظلُّمات وشكاوى إلى المحكمة الجنائية ومكتب النائب العام. وقد قدمت السلطات ردودًا غير واضحة على طلباتها ولم تقم رسميًا بإزالة اسمها من ملف القضية، الذي لا يزال معروضًا أمام نيابة أمن الدولة العليا.

ولا تزال قرارات حظر السفر تُستخدم في مصر كأداة لتقييد حركة المدافعين عن حقوق الإنسان، والعاملين في المنظمات غير الحكومية، والمحامين، والمحتجزين السابقين، وغالبًا دون إجراءات قانونية سليمة أو إخطار رسمي.

وتدعو المنظمات الموقعة أدناه السلطات المصرية إلى القيام فورًا بما يلي:

رفع حظر السفر التعسفي المفروض على هدى عبد الوهاب، وكذلك القيود المماثلة التي تستهدف المدافعين عن حقوق الإنسان وأفراد المجتمع المدني

تقديم توضيح قانوني واضح بشأن وضع عبد الوهاب في القضية رقم 173 لسنة 2011، خاصة في ضوء الإعلان الرسمي عن إغلاق القضية

الإقرار بأن المركز العربي لاستقلال القضاء والمحاماة لم يُحال إلى المحاكمة ولم يخضع لتحقيق رسمي، وأن إغلاق القضية رقم 173 لسنة 2011 يؤكد عدم وجود أسس لاتخاذ إجراءات جنائية

تقديم تعويضات عن القيود المطوّلة التي واجهتها هدى عبد الوهاب نتيجة حظر السفر التعسفي والتدابير المرتبطة به

ضمان حماية المجتمع المدني والمدافعين عن حقوق الإنسان حتى يتمكنوا من العمل دون خوف من الترهيب أو المضايقات القضائية أو القيود.

🔴 Interference in the affairs of justice is a crime not subject to statute of limitations
The Justice Support Foundation at the Arab Center for the Independence of the Judiciary and the Legal Profession expresses its profound concern and deep disquiet regarding circulating reports of directives issued by the executive authority seeking to abolish the Judges’ Appointments Office at the Office of the General Prosecutor, assign the Military Academy responsibility for the training and appointment of new assistant prosecutors, and assume authority over judicial promotion files. This concern is further exacerbated by the fact that, as of the issuance of this statement, no official body has come forward to deny these reports.
The Foundation affirms that judges, as those entrusted with making final determinations affecting citizens’ lives, freedoms, rights, obligations, and property, in accordance with the United Nations Basic Principles on the Independence of the Judiciary, are not defending a private or corporatist interest. Rather, judicial independence is a matter that directly concerns the fundamental rights and freedoms of citizens and the protection of both private and public property.

التدخل فى شئون العدالة جريمة لا تسقط بالتقادم

🔴تعرب مؤسسة دعم العدالة بالمركز العربي لاستقلال القضاء والمحاماة، عن قلقها وإنزعاجها الشديدين بشأن الأخبار المتداولة عن صدور توجيهات من السلطة التنفيذية بشأن السعى الى إلغاء مكتب تعيينات القضاة بمكتب النائب العام، وتولّي الأكاديمية العسكرية شئون التدريب والتعيين لمعاونى النيابة الجدد، إلى جانب ملف الترقيات بالقضاء، ويزيد من حدة هذا القلق، أن تلك الأنباء لم يبادر إلى نفيها أية جهة رسمية حتى كتابة هذا البيان .
وتؤكد المؤسسة على أن القضاة وباعتبارهم المكلفون بإتخاذ القرار الأخير بشأن حياة المواطنين وحرياتهم وحقوقهم وواجباتهم وممتلكاتهم وفقا لمبادئ الأمم المتحدة بشأن السلطة القضائية، فأن إستقلال القضاء ليس شأنا خاصا بهم أو بحقوقهم، بل أنه شأن يمس حقوق المواطنين وحرياتهم الأساسية وممتلكاتهم الخاصة والعامة .

◾ On the sidelines of the Assembly of States Parties to the International Criminal Court
The ACIJLP discusses
"The current position of Arab states regarding the International Criminal Court"

◾ The Arab Center for the Independence of the Judiciary and the Legal Profession (ACIJLP), in cooperation with the Arab Coalition for the International Criminal Court, held a seminar on the margins of the Assembly of States Parties convened in The Hague from December 1–6, 2025, entitled “The current position of Arab states regarding the International Criminal Court.” The seminar was attended by numerous representatives of International Criminal Court (ICC) member states, international and regional organizations, and members of the Secretariat of the Coalition for the International Criminal Court.

Nasser Amin, Director of the ACIJLP, reviewed the evolution of Arab states’ positions from the 1998 Rome Conference to the present day. He noted that the Arab stance has undergone significant shifts over almost 27 years, ranging from outright rejection and caution toward the very concept of the ICC to a limited rate of ratification of the Rome Statute, with only 13 Arab states having done so. This was followed by a further development marked by the ratification of the Statute by five Arab states (Jordan, Djibouti, Comoros, Tunisia, and Palestine), and subsequently by growing support from several countries in the region for the Court’s work and commendation of its recent decisions. However, no substantial progress has been made toward additional accessions to the Court.

عقد المركز العربي والتحالف العربي من أجل المحكمة الجنائية الدولية، ندوة على هامش انعقاد مؤتمر جمعية الدول الاطراف للمحكمة الجنائية الدولية المنعقد في لاهاي في الفترة من 1 – 6 ديسمبر 2025 ، بعنوان ( موقف الدول العربية من المحكمة الجنائية الدولية في الوقت الراهن ). بمشاركة عديد من ممثلى الدول الاعضاء بالمحكمة الجنائية الدولية والمنظمات الدولية والاقليمية . واعضاء امانة التحالف الدولى من اجل المحكمة.

وقد إستعرض ناصر أمين مدير المركز ، تطور موقف الدول العربية منذ مؤتمر روما 1998، وحتى اللحظة الراهنة، وقد أشار إلى أن هناك تطورات كبيرة حدثت في موقف الدول العربية على مدار ما يقرب من 27 عاما، تراوحت هذه المواقف من الرفض والحذر لفكرة المحكمة الجنائية من الأساس ، إلى إنخفاض معدل التوقيع على إتفاقية روما المنشئة للمحكمة و التي لم تتجاوز 13 دولة عربية فقط، مرورا بتطور هذا الموقف بتصديق 5 دول عربية وهم (الأردن وجيبوتي وجزر القمر وتونس وفلسطين). ثم تأييد العديد من دول المنطقة لعمل المحكمة والإشادة بقراراتها التى أصدرتها مؤخرا . دون تقدم محرز فى سياق الإنضمام إلى المحكمة.

🔴 Urgent call : Sudan’s Al-Fashir : An ongoing humanitarian crisis

◾The Arab Center for the Independence of the Judiciary and the Legal Profession (ACIJLP), together with the Arab Coalition for the International Criminal Court, is following with deep concern the unfolding humanitarian crisis in the city of Al-Fashir, the capital of North Darfur in Sudan. The two organizations call upon the international community, the warring parties, and human rights and humanitarian organizations to act urgently to halt the ongoing catastrophe in Al-Fashir and the grave violations being committed against the civilian population.

◾Eyewitness accounts from the city, corroborated by numerous verified reports, confirm that the armed conflict between the Sudanese Armed Forces and the Rapid Support Forces has resulted in serious breaches of international humanitarian law and international human rights law, including acts that may amount to war crimes and crimes against humanity under the Rome Statute of the International Criminal Court.

السودان - الفاشر – كارثة إنسانية مستمرة .

▪️ يتابع المركز العربي لاستقلال القضاء والمحاماة ، والتحالف العربي من أجل المحكمة الجنائية الدولية ببالغ القلق الأزمة الإنسانية في مدينة الفاشر عاصمة الإقليم الشمالى لدارفور بالسودان، ويطالبان المجتمع الدولي والأطراف المتحاربة والمنظمات الحقوقية والإنسانية إلي سرعة التحرك لوقف الكارثة الجارية بالفاشر والانتهاكات الجسيمة بحق السكان المدنيين.
فقد أكدت شهادات حية من الداخل وأيدتها العديد من التقارير الموثقة ، أن النزاع المسلح بين الجيش السوداني ومليشيات الدعم السريع قد انتهكا القانون الدولي الإنساني والقانون الدولى لحقوق الانسان ، وإرتكاب جرائم قد ترقى لمستوى جرائم حرب وجرائم ضد الإنسانية طبقا لميثاق روما المنشئ للمحكمة الجنائية الدولية.
▪️ ويشير المركز العربي أن مدينة الفاشر تعاني كارثة إنسانية مازالت أحداثها تتفاقم، فقد توقفت المستشفيات عن العمل ونفذت الأدوية- وفقا لأطباء سودانيون- كما تعرضت المستشفى السعودي ومسجد قريب منها يأوي لاجئين للقصف مما أدي لمقتل عشرات المدنيين .
كما تعددت الانتهاكات بحق المدنيين منها:
•مقتل ما لا يقل عن 73 طفلا دون الخامسة و22 من كبار السن نتيجة التجويع خلال 40 يوما بمعسكر ( أبو شوك ).
•تم قصف مخيمات اللاجئين مما أدي لمقتل العشرات بينهم أطفال، واستهداف المدنيين بشكل متعمد، خاصة المنتمين لمجموعات إثنية معينة، حيث يتعرضون للتعذيب والإعدامات الميدانية.
•استخدام العنف الجنسي كسلاح حرب علي نطاق واسع، حيث تتعرض الفتيات والنساء للاغتصاب الجماعي.
•تعرض مجموعات إثنية للتهجير القسري من بيوتهم وقراهم ونزع الملكيات الزراعية، مما يمثل جريمة التطهير العرقي وهي جريمة ضد الإنسانية بموجب ميثاق روما الأساسي.
•الحصار الشامل لسكان المدينة ومنع مئات الآلاف من السكان من الوصول للغذاء والماء النظيف والدواء والرعاية الصحية، وهو الحصار الذي يهدف لتجويع السكان.
▪️ ويؤكد المركز العربي والتحالف العربي من أجل المحكمة الجنائية الدولية أن المأساة التي يعيشها سكان مدينة الفاشر المدنيون ليست نتيجة كارثة طبيعية، وإنما ناتجة عن صراع وحشي انتهك اتفاقيات جنيف الأربع لعام 1949، وخاصة الانتهاكات الجسيمة المتعلقة بحماية المدنيين في زمن النزاع المسلح.
▪️ كما تمثل تلك الممارسات انتهاكا صريحا لأحكام المواد 6 و7 و8 من النظام الأساسى للمحكمة الجنائية الدولية .
ويطالب المركز العربي والتحالف العربي، المجتمع الدولي بسرعة التدخل والعمل على:
▪️فتح ممرات إنسانية آمنة ودائمة دون عوائق، تسمح للمنظمات الدولية والإقليمية بتقديم المساعدات الإنسانية العاجلة (الغذاء، الدواء، المياه) للمدنيين المحاصرين.
▪️فرض وتحديد منطقة آمنة تحت حماية دولية في الفاشر لحماية السكان من الهجمات المستمرة.
▪️ضم التحقيقات المتعلقة بتلك الواقعة للتحقيقات التى يجريها المدعى العام بالمحكمةالجنائية الدولية بشأن حالة السودان .

🟥 Government amendments to the Criminal Procedures Law violate constitutional provisions

The Arab Center for the Independence of the Judiciary and the Legal Profession (ACIJLP) followed with deep concern and dismay the decision of the House of Representatives, during a single session held on 16 October, to approve the amendments introduced by the government to the draft Criminal Procedures Law, in response to the observations contained in the presidential memorandum regarding eight articles of the said draft. The approval was granted without any notable modification, as the government’s proposals were endorsed in their entirety, despite the clear unconstitutionality of certain provisions added by the government. Even more troubling is the claim that the Constitution does not explicitly address the concept of procedural necessity, or, in other words, that it is “constitutionally deficient.”

🟥 إقرار لتعديلات الحكومة على قانون الإجراءات الجنائية إنتهاك لأحكام الدستور

تابع المركز العربي بمزيد من القلق والإنزعاج البالغ، قيام مجلس النواب خلال جلسة واحدة صباح اليوم، بإقرار التعديلات التي أدخلتها الحكومة على مشروع قانون الإجراءات الجنائية بناء على ملاحظات المذكرة الرئاسية بشأن ثماني مواد من المشروع المشار إليه، ودون تعديل يذكر، فما قدمته الحكومة تمت الموافقة عليه وإقراره كما هو، بالرغم من وضوح مخالفة بعض الأحكام المضافة من الحكومة لمواد الدستور، بل والزعم بأن الدستور لم يتطرق صراحة لحالة الضرورة الإجرائية، أو بمعنى آخر (قصور الدستور).

ويرى المركز العربي أن موافقة مجلس النواب على نص المادة 48 من قانون الإجراءات الجنائية بعد تعديلها، والتي تجيز لرجال السلطة العامة دخول المنازل والمحال المسكونة (فى حالات الاستغاثة أو الخطر الناجم أو الحريق أو الغرق أو ماشابه ذلك). بإضافة عبارة (وما شابه ذلك) تفتح الباب واسعا أمام رجال السلطة العامة في دخول المنازل دون إذن قضائي مسبب مما يعد انتهاكا لأحكام المادة 58 من الدستور، ولحرمة المنازل.
