Have you heard about the case of Tiffany & Co. vs. Costco (2013)?
Tiffany & Co. sued Costco Wholesale Corporation for selling diamond engagement rings described as “Tiffany” rings, despite not being affiliated with Tiffany & Co.
Issue: Tiffany & Co. claimed trademark infringement, arguing that Costco misled customers by using the Tiffany name to describe the rings
Outcome: In 2015, a judge ruled in favor of Tiffany & Co., awarding the company $19.4 million in damages. Costco later appealed, and in 2020, a federal appeals court overturned part of the verdict, but the case continued to be a major example of trademark enforcement in the retail industry.
