19.11.2025 Eestis on vastu võetud olulised muudatused töölepingu seaduses - ja need muudavad reegleid kõigile tööandjatele ning osalise koormusega töötajatele.

Muudatuste jõustumisel hakkab kehtima uus paindliku tööaja kokkulepe.
See on võimalus, mis lubab osalise koormusega töötajal teha lisatunde ja soovi korral töötada peaaegu täiskoormusel – kuid ainult siis, kui kõik nõuded on täidetud.

Mida peavad teadma tööandjad ja töötajad:

✨ Ainult kirjalikult.
Kokkulepe peab olema kirjalik ja sisaldama kokkulepitud töötunde, lisatunde ning etteteatamise aega.

✨ Tunnitasu vähemalt 1,2×.
Tasu peab olema kõrgem kui alammäär – ka alaealiste puhul.

✨ Vähemalt 10 tundi nädalas.
Paindlikku tööaega saab kasutada siis, kui töötaja töötab vähemalt veerand koormusega.

✨ Õigus lisatundidest keelduda.
Lisatunnid pole kohustuslikud – töötaja kinnitab nõusolekut iga kord eraldi.

✨ Ületunnid eraldi välja toodud.
Arvestusperioodi lõpus peab tööandja esitama selge tööajakava: kokkulepitud tunnid, lisatunnid ja ületunnid.

✨ Kaitse koormuse vähendamise vastu.
Kui töötaja töötab kuue kuu jooksul pidevalt rohkem, võib ta nõuda tööaja suurendamist.

✨ Uued reeglid alaealistele.
Täpsustati lubatud töötunde ning 15–17-aastased põhikooli lõpetajad võivad töötada täiskoormusel seadusliku esindaja nõusolekul.

⚖️ Need muudatused nõuavad korrektset rakendamist. Valesti vormistatud kokkulepped võivad olla tühised ning tuua kaasa töövaidlusi lisatundide ja tasustamise üle.

Estonia currently ranks first in the International Tax Competitiveness Index and enables entrepreneurs to pay Estonian taxes entirely online and simple. If you are doing business in Estonia, you will be responsible for paying taxes in accordance with the tax legislation in force in Estonia. Property, income and benefits are taxable. The general rule is that all companies are taxed equally and on the same substantive basis.

Here is an overview(2022):
⚡The corporate income tax applicable to dividends is 20/80.
⚡The rate applicable to dividends paid on a regular basis is 14/86 and the rate of income tax on dividends paid to a natural person is 7%.
⚡Value added tax varies between 20%, 9% and 0%,
⚡The natural person income tax rate is 20%
⚡The pension fund payment rate is 2%
⚡Unemployment insurance contribution rate for employees is 1.6%
⚡Unemployment insurance tax rate for employers is 0.8%

Checklist of questions for drafting a contract:

🔹Who concludes the contract? Elementary, right? I will tell you this, in the most elementary things there are risks. Check if the person who is negotiating with you is definitely connected with this company and has the authority to sign.

🔹What is the subject of the contract?
Both parties must understand who and what is obliged to do, in what time frame. For example, one person writes a song and transfers it and the rights to use it, and another person pays a certain amount at a certain time. The song is transferred in a certain way (for example, on a physical media or via cloud storage) and within a certain period of time.

🔹Associated obligations and promises
In addition to a simple description of the subject of the contract, it is necessary to fix side obligations. For example, a song must be at least 3 minutes long, of a certain quality, in a certain language, in a certain arrangement, a guarantee of the originality of the work, etc. The more detailed it is, the less misunderstandings.

🔹 Sanctions
To ensure discipline and motivation in the proper performance of the contract, it is necessary to prescribe provisions, fines or other punishments (except bodily injury) for violations of specific clauses of the contract or obligations, as well as the procedure for their payment. You need to understand what will happen if one party does not pay? What if the other side misses the deadline? What if the job is done and the other side doesn’t accept it?

🔹Force Majeure
If before the coronavirus pandemic and the war in Ukraine everyone copied the template text, now entrepreneurs should pay more attention to this clause. Unfortunately, many have come up against the fact that the template force majeure provisions do not adequately take into account their risks. In this case, issues not regulated by the contract are resolved according to the letter of the law, and as we know, it can be interpreted in different ways.
