Can Foreigners Divorce in Ecuador? Yes—Here’s How

Foreigners who were married abroad may legally divorce in Ecuador, provided that one of the spouses holds temporary or permanent residency in the country. However, before starting the divorce process, the marriage must be officially registered with the Ecuadorian Civil Registry. This registration is a separate legal step and is mandatory in order to proceed with any divorce in Ecuador. Once registered, the divorce can be completed even if one spouse lives outside the country.

There are three main ways to obtain a divorce in Ecuador:
1. Notarial Divorce (Recommended): This is the fastest and most affordable option. If both spouses agree, the divorce is completed before a Notary in approximately 40 minutes and later registered with the Civil Registry.
2. Judicial Divorce by Mutual Agreement: Filed before a judge when both spouses consent. This process takes around 6 to 8 months and requires a court hearing.
3. Judicial Divorce Without Agreement: Initiated when one spouse does not consent or cannot be located. Legal grounds must be proven, such as prolonged separation or lack of marital harmony.

Basic requirements include an
- Ecuadorian marriage certificate
- Identification documents (cédula or passport)
- Birth certificates of any children, if applicable.

If You Have Minor Children:
Regardless of the divorce method, child support, custody, and visitation must be agreed upon or determined by a judge. Mediation can make this process faster and more cost-effective.

Final Step:
Every divorce must be registered with the Civil Registry to be legally valid. The registered divorce certificate can be used worldwide for legal, financial, immigration, and property matters. Afterward, remember to update your cédula and divide any marital assets in Ecuador.

Important Notice for Property Owners in Ecuador

If you have purchased a property in Ecuador, it is essential to understand that the process is not fully completed once the deed is registered at the Property Registry. Many owners are unaware — or simply forget — that there is an additional and indispensable step: updating the ownership name at the municipal level.

This municipal name change is not just a formality. It is a legal requirement that ensures your rights as the true owner of the property.

Why this step is important:
1. Having the property registered under your name within the municipality allows you to act as the owner for sales, donations, and legal transfers.
2. It enables you to obtain municipal permits for construction, remodeling, or land use.
3. It allows you to pay property taxes under your own name and maintain a clean legal record.
4. It gives you access to senior citizen tax discounts, when applicable.
5. This tax payment must be in your name because you are the legal owner of the property. If it is not, it could lead to legal and administrative problems in the future.

Requirements for the municipal name change:
1. Copy of the public deed of sale of your property.
2. Proof of payment of the municipal property tax (predial tax).
3. Third-party authorization form, if you are sending someone else to complete the process on your behalf.
4. A form that must be completed when the property was acquired under a marital partnership or any type of co-ownership, to determine under whose name the property should be registered.

All documentation must be submitted in person, in physical form, at the municipal offices.

Attention Property Owners in Ecuador

Living in Ecuador comes with many benefits—but if you own property here, it also comes with important responsibilities that are easy to overlook, especially if you’re unfamiliar with the local system.

Every person who owns Real Estate Property in Ecuador is required to pay Municipal Property Taxes each year, including the urban or rural property tax (impuesto predial). This obligation applies regardless of your nationality or residency status. It is paid once a year, and staying current helps you avoid unnecessary stress, fines, interests, or administrative roadblocks.

The good news? Ecuadorian municipalities encourage early payment by offering attractive discounts.

For urban properties, discounts are available during the first six months of the year and are divided into two payment periods each month:

- January: 10% discount in the first half, 9% in the second
- February: 8% (first half) and 7% (second half)
- March: 6% and 5%
- The discount gradually decreases until it reaches 1% in the second half of June

For rural properties, owners receive a 10% discount if payment is made within the first 45 days of the year, up to February 15.

Paying your municipal taxes on time is more important than it may seem. Any outstanding balance can prevent you from completing basic procedures, such as transferring ownership after buying or selling a property. Late payments also generate interest and penalties that can quickly add up.

Additionally, if you are older than 65, you can obtain senior discounts on your taxes too.

If you’re a foreigner renting in Ecuador and you’ve noticed issues like water leaks, damaged flooring, broken locks, electrical failures, humidity problems, or anything that affects your comfort and safety, this information is going to help you a lot.

What many tenants don’t realize is that Ecuadorian law offers strong protection when it comes to repairs and property conditions.

1. Your Landlord Must Keep the Property in Good Condition.-
Under Ecuador’s current regulations, the landlord has a legal obligation to maintain the rental property in proper, livable condition. This includes making all necessary repairs during the lease—plumbing issues, structural damage, malfunctioning locks, electrical defects, and anything essential for safe living.
If you report a problem and your landlord ignores it, the law gives you important rights.

2. You Can Make Essential Repairs Yourself—Then Request Reimbursement .-
If the landlord does not fix the defects after you notify them, you are legally allowed to make the repairs on your own and later request reimbursement for the cost.
To apply this right correctly, these conditions must be met:
1. The repairs must be essential for using the property safely.
2. The damage cannot be your fault.
3. You must notify the landlord promptly, giving them the chance to handle the repair first.
4. Costs must be reasonable, aligned with fair market prices.
All of this is fully supported by Ecuadorian law, but if you don't follow the legal considerations properly, you could be liable for alterations to the property or lose your right to a reimbursement of the repairs.

3. You Can Also Request a Rent Reduction.-
According to the Tenancy Law, if the property becomes deteriorated due to natural wear or issues not caused by you, the tenant is entitled to request a temporary reduction in the monthly rent until the problem is resolved.

Important Update for CREA Users: What You Need to Know About Your Refund Process

Attention CREA users: here is the latest follow-up on the status of your pending payments from Cooperativa CREA. This update aims to give you a clear, reliable overview of how the process is moving forward and what you can expect next.

First, if you had up to $32,000—or more—you should have already received payment from COSEDE through the first two groups that were called. If you have not been contacted yet, don’t worry: a third group will be announced in December. We personally spoke with the CREA current representative, who confirmed that payments will continue throughout December by the COSEDE.

At the moment, CREA is prioritizing payments to vulnerable groups, including pregnant women, people with disabilities, seniors, children and adolescents, and individuals with catastrophic illnesses. These users are currently being contacted to receive the full amount of their funds.

From November 28 to February 21, all individuals belonging to these priority groups may visit any JEP Cooperative agency to complete their claim. Make sure to bring:
- Two notarized, color copies of your savings book or CD.
- Two notarized, color copies of your ID card or passport.
- Two copies of any document that legally proves your claim.

If you have over $32,000, have already received the COSEDE payment, but still have a pending balance—and you are not part of a priority group— CREA will cover those remaining amounts progressively, as these payments depend on the liquidation of CREA’s assets. If you are part of one of the priority groups, don't wait anymore! Go to JEP and claim your funds now.

If you have $32,000 or more and have not been contacted by COSEDE yet, remain calm: You should be included in the new call from COSEDE this December. COSEDE will refund up to $32,000, and the remaining balance will be paid later by CREA, as their assets are sold, if you are not part of any priority group.

If your balance is under $32,000, your refund comes exclusively from COSEDE—not from CREA—and COSEDE should include you in the upcoming December group if you haven’t been contacted yet.

If you need help preparing notarized documents for claiming the money, or if you are part of a priority group but you have not been able to recover 100% of your funds, feel free to contact us.

Important warning:
If you had more than $32,000, you were required to submit the official Acreencias Form with the necessary documentation. If you did not complete this process, CREA cannot reimburse you funds.

Understanding How Wills Work in Ecuador: What Every Expat Should Know

If you live in Ecuador or own property here, it’s essential to understand how inheritance laws work. Under Ecuadorian law, you don’t have full freedom to distribute your assets as you wish.

Even with a will, a large portion of your estate must go to your children. Still, there are legal mechanisms to protect your surviving spouse or partner.

Inheritance With a Will: Ecuador’s Civil Code divides your estate into three parts:
- 50% must be distributed equally among your children (and your parents, if they’re still alive).
- 25% can be assigned among your descendants (children, grandchildren, etc.) in whatever proportions you choose.
- 25% is entirely yours to give freely—to a spouse, partner, friend, or even a charity.

This system aims to protect family members, especially children, from being disinherited. While restrictive compared to U.S. or European laws, proper legal planning allows you to structure your estate so your spouse or partner receives protection and financial stability.

Inheritance Without a Will: If you die without a will (intestate succession), Ecuadorian law strictly determines who inherits:
1. Children inherit everything.
2. If no children, spouse and parents share equally.
3. If no parents, everything goes to the spouse.
4. Then siblings, nieces and nephews, and cousins.
5. If no relatives, the government receives the estate.

For expats living alone in Ecuador, this last point is crucial—without a will, your assets could end up with the state if no relatives claim them.

Protecting Your Spouse or Partner
Unlike in many Western countries, you cannot legally leave everything to your surviving spouse. However, there are valid strategies to achieve similar results, such as:
· Renunciation of marital property rights (renuncia de gananciales)
· Marital or prenuptial agreements (capitulaciones matrimoniales)
· Special provisions within the will
