Ηow will Undivided Properties be sold in Cyprus – What is changing?

Exciting News. The law firm G. Kouzalis LLC would like to inform you about the significant changes in the expected legal framework regarding undivided real estate in Cyprus.

The management of undivided properties in Cyprus has long been one of the most complex issues in the Cypriot real estate market. These are cases where a property belongs to more than one owner (co-ownership), without any physical or legal separation of the shares. Recent developments bring significant changes to the way in which these properties can be sold, with the aim of simplifying procedures and strengthening the market.

What are undivided properties?
Undivided property is considered any property that belongs to two or more persons, without being separated into separate properties. This often happens in cases of inheritance, family property or joint investments, where no distribution or agreement has been made for individual properties.

The problem arises when one of the co-owners wishes to sell his share or when there is a need to develop the property, but there is no unanimity between all parties.

Changes in the legal framework
The new regulations aim to overcome the obstacles that until now made the sale of such properties difficult or impossible. The main changes include:
1. Facilitation of share sales
Owners gain more flexibility in selling their share, even without the consent of all co-owners, under specific conditions.
2. Judicial intervention
In cases of disagreement, the possibility of recourse to the court is given, which can order the sale of the property and the distribution of the proceeds among the co-owners.

Η διαχείριση των αδιανέμητων ακινήτων στην αποτελεί διαχρονικά ένα από τα πιο σύνθετα ζητήματα στην κυπριακή αγορά ακινήτων. Πρόκειται για περιπτώσεις όπου ένα ακίνητο ανήκει σε περισσότερους ιδιοκτήτες (συνιδιοκτησία), χωρίς να έχει γίνει φυσικός ή νομικός διαχωρισμός των μεριδίων. Οι πρόσφατες εξελίξεις φέρνουν σημαντικές αλλαγές στον τρόπο με τον οποίο αυτά τα ακίνητα μπορούν να πωληθούν, με στόχο την απλοποίηση διαδικασιών και την ενίσχυση της αγοράς.

Τι είναι τα αδιανέμητα ακίνητα

Αδιανέμητο ακίνητο θεωρείται κάθε περιουσία που ανήκει σε δύο ή περισσότερα πρόσωπα, χωρίς να έχει διαχωριστεί σε ξεχωριστές ιδιοκτησίες. Αυτό συμβαίνει συχνά σε περιπτώσεις κληρονομιάς, οικογενειακών περιουσιών ή συνεπενδύσεων, όπου δεν έχει γίνει διανομή ή συμφωνία για επιμέρους ιδιοκτησίες.
Το πρόβλημα προκύπτει όταν ένας από τους συνιδιοκτήτες επιθυμεί να πουλήσει το μερίδιό του ή όταν υπάρχει ανάγκη αξιοποίησης του ακινήτου, αλλά δεν υπάρχει ομοφωνία μεταξύ όλων των μερών.

Οι αλλαγές στο νομικό πλαίσιο
Οι νέες ρυθμίσεις στοχεύουν στο να ξεπεραστούν τα εμπόδια που μέχρι σήμερα καθιστούσαν δύσκολη ή και αδύνατη την πώληση τέτοιων ακινήτων. Οι βασικές αλλαγές περιλαμβάνουν:
1. Διευκόλυνση πώλησης μεριδίου
Οι ιδιοκτήτες αποκτούν περισσότερη ευελιξία στην πώληση του ποσοστού τους, ακόμη και χωρίς τη συγκατάθεση όλων των συνιδιοκτητών, υπό συγκεκριμένες προϋποθέσεις.

2. Δικαστική παρέμβαση

Οι διαδικασίες πώλησης γίνονται πιο ξεκάθαρες και διαφανείς, με καθορισμένα βήματα και χρονοδιαγράμματα.

5. Επιπτώσεις στην αγορά ακινήτων

Significant progress for Cyprus’ Schengen accession- Decisions coming soon

Cyprus is closer than ever to joining the Schengen Area, with the latest European assessments recording substantial progress and now transferring the burden of the process from the technical to the political level.

In his recent public statements, Nikos Christodoulides stated that the country has made significant progress in its preparations and expressed the assessment that political decisions are expected towards the end of 2026 or the beginning of 2027. The issue is presented by the government as a strategic milestone for the country’s European path.

According to recent reports from the European Commission, Cyprus has made progress on the technical requirements related to the functioning of the Schengen system, including issues of border management, information exchange and cooperation in the fields of security and migration.

Magnus Brunner, stated that there is optimism about the completion of the process, noting that the final accession will depend on an official confirmation of the country’s readiness and then on a political decision be the Schengen participating states.
Cyprus’ accession to Schengen is considered particularly important as it is expected to strengthen:
• the free movement of citizens,
• tourism and business activities,
• attracting investment,
• and the deeper integration of the country into European cooperation mechanisms.

Although the indications are considered positive, the final course will depend on collective decisions at the European level and on the way to manage specific issues related to the specificities of Cyprus, including the Green Line.

The Pontian Genocide refers to the systematic ethnic cleansing, forced deportations, death marches, and massacres of the Christian Greek population in the Ottoman Empire's Pontus region. This campaign took place alongside the Armenian and Assyrian genocides.

The Date (May 19th):
This specific date marks the day in 1919 when Mustafa Kemal (Atatürk) landed in Samsun. This event initiated the final, most intense phase of the atrocities against the region's Greek population.

The Casualties: Historical sources and records estimate that between 300,000 and 353,000 Pontian Greeks lost their lives during this period (1914–1923).

The Greek Parliament officially recognized the atrocities as a genocide in 1994, designating May 19th as the National Day of Remembrance.
