Managing Partner Yiannos Georgiades speaker at GLA International Conference on Litigation & Arbitration, Dubai Edition 2025
We are proud to announce that Yiannos Georgiades, Managing Partner of Georgiades & Associates, participated as an eminent speaker and panelist at the GLA International Conference on Litigation & Arbitration held in Dubai in 2025. His insights on the critical role of the New York Convention in recognizing and enforcing arbitral awards in cross-border disputes resonated with attendees from the legal and business communities.
During his session, Mr. Georgiades emphasized the significance of the recognition and enforcement of arbitral awards, which serves as a fundamental cornerstone for parties engaged in international arbitration. He outlined the reasons for refusal of enforcement under Article 5 of the New York Convention, particularly highlighting how some jurisdictions might exploit these provisions, especially concerning public policy arguments, to hinder enforcement efforts.
Mr. Georgiades called for greater consistency among member states, advocating for the recognition and enforcement of not only final arbitral awards but also interim orders issued by arbitrators. He stressed the need for enabling the issuance of interim orders pending arbitration in another country, which would enhance the effectiveness of arbitration as a dispute resolution mechanism.
In his remarks, he pointed out that facilitating the recognition and enforcement of foreign arbitral awards is beneficial for all countries, as it attracts foreign investment and joint ventures. Mr. Georgiades cited the UAE and Saudi Arabia as prime examples of countries that have reformed their legal frameworks to align more closely with international standards, particularly common law principles.
He referenced recent case law from the Dubai International Financial Centre (DIFC), which affirmed that foreign interim awards can be recognized and enforced, showcasing a progressive approach to arbitration law. Additionally, he noted the express provision in Abu Dhabi’s law regarding the recognition of interim orders. However, he raised concerns about the current ambiguity in Saudi Arabia regarding the recognition of interim orders, indicating a need for further clarity in their legal approach.
He also made a reference on European law and Cyprus law on Recognition and enforcement of arbitral awards and made comparisons with court judgments!
