As a result, Shakira used the horn riff from Rivera’s song throughout her hit single “Hips don’t lie”, without violating any copyrights and making this instrumental part one of the most well known riffs in the world.

Are you a videographer or photographer? Do you want to create a work in public spaces? Do you know your rights and responsibilities? What happens with the right to privacy, the protection of family and personal life as well as the prohibition of personal data processing in public spaces? The Constitution of Cyprus does recognise and protect the right of freedom of expression, including the artistic expression (article 19 of the Constitution). Article 6(2)(i) of the Cypriot Law (138(I)/2001) states that there is an exception regarding the prohibition of sensitive personal data processing, when the latter one exclusively concerns the artistic expression, given that the processing doesn’t violate the right to family and private life. However, one should always bear in mind the proportionality principle and the fair balance between the different rights at stake.

Do you know your legal obligations?

The most crucial influencers’ obligation is the legal requirement outlined in article 9 of the Audiovisual Media Services Directive (AVMSD), regarding the identification principle and the subsequent disclosure of paid content, shared on social media influencer’s pages and posts.

The disclosure of sponsorship or hidden marketing constitutes a well established principle which requires that an advertisement is identifiable as such so that the commercial nature of a certain content or message is clear.

2000 followers - “nano influencers”
2000 - 10 000 followers - “micro influencers”
10 000+ followers - normal influencers
Millions of followers - huge celebrities

The spectrum of natural or legal persons that can be classified as influencers differs in various ways. Bloggers, vloggers, online publishers are only some of the digital influencers that engage with commercial communications and digital advertising activities online.

In terms of defining digital influencers, the guidelines issued by the International Consumer Protection and Enforcement Network indicate that an influencer should be deemed anyone that posts online content on a website, an online platform or a social media account.

At the same time this content should include an opinion experience or other information about a market, business, good or service.

This may refer to creators of, or contributors to web logs (blogs), video logs (vlogs), microblogs on social media, including tweets, online newspapers/ magazines and other online publications.

According to the UCPD and AVMSD (in EU level) an influencer has to be classified as a trader and audiovisual media service provider in order to have legal obligations against consumers.

This will happen on 12 May, coinciding with the International Day of Nurses, during a virtual online awards ceremony at 17:30 Geneva time. Some of our jurors will join and we'll make this ceremony entertaining, informative and interactive with the audience on Facebook. It will be a tribute to all champions of health!
