Are you about to buy a property near the beach in Costa Rica?

Before you evaluate the price or pay a deposit, there is one essential legal issue to verify: many properties located along Costa Rica's coastline may fall within the Maritime-Terrestrial Zone (ZMT).

This means that what is being offered is not always titled private property. It may be a concession—a right to use public-domain land for a defined term, subject to specific conditions and administrative approvals.

Before moving forward, it is important to:

- Determine whether it is titled property or a concession.
- Verify the Folio Real, survey plan, and location of the property.
- If it is a concession, review its validity, remaining term, authorized use, concession fee, and transfer conditions.
- Confirm permits, restrictions, and buyer eligibility.

The property's location and appearance do not determine the legal right you are acquiring. Identifying that right correctly should be the first step in the negotiation.
