📝 Why Is It So Important to Have a Will in Costa Rica?

Read more: https://www.expatslegalcr.com/willscostarica

Living in Costa Rica or investing in this beautiful country is an exciting step—but it also comes with important legal responsibilities that many people overlook.

One of the most critical (and often delayed) decisions is creating a valid will in Costa Rica.

If you hold property, investments, or even a bank account here, having a local will is essential to ensure your assets are protected and distributed according to your wishes.

⚠️ Without a will, your loved ones may face:

• Long and costly legal processes
• Complicated inheritance procedures
• Delays accessing assets
• Potential family conflicts
• Legal uncertainty under Costa Rican law

👉 Foreign wills do NOT automatically protect your assets in Costa Rica.

A properly drafted Costa Rican will ensures:

✔️ Your wishes are respected
✔️ Your family is protected
✔️ Your assets are distributed efficiently
✔️ Peace of mind for you and your loved ones

➡️*FAQ Insights:*

✅The proposed legislation does not offer any exemptions for property owners under the new rules.

✅Foreign property ownership carries risks, as individuals may hold assets or property without a valid, permanent identification number (DIMEX). Using a passport number, as a temporary document, poses challenges for ownership and may result in legal issues in the future.

✅Understanding the difference between tourism and long-term residency is vital, as tourism is intended for short stays, while living or investing in a country requires different legal considerations.

Here’s a summary of the key points regarding the Bill to regulate the re-entry of foreigners in perpetual tourist status in Costa Rica:

➡️*Context:* Countries in visa group 1 (e.g., USA, Canada) can stay in Costa Rica for up to 180 days for tourism purposes, but the misuse of this rule has necessitated regulation of perpetual tourism.

➡️*Objective:* The bill seeks to regulate the "visa run" practice, where foreigners temporarily leave to renew their tourist status, enabling indefinite stays without legal residency.

➡️*Concerns:* The practice of "visa runs" has raised issues concerning foreign tourists exploiting legal loopholes, which affects Costa Rica's Social Security system and small towns.

➡️*Monitoring Issues:* Insufficient control over tourists and the growth of companies facilitating "visa runs" complicate immigration management.

➡️*Legal Uncertainty:* Foreigners buying property or opening LLCs under changing passport numbers face risks from inconsistent immigration status.

➡️*Societal Impact:* Gentrification resulting from foreign land acquisition has displaced local residents and raised living costs, causing concern among Costa Ricans.

➡️*International Comparison:* Other countries, especially in Europe, have enacted strict regulations to prevent "visa runs," including penalties for avoiding immigration laws.

➡️*Proposed Regulations:* The bill proposes stricter rules for perpetual tourists while allowing exceptions for certain groups, ensuring the integrity of immigration management.

➡️*Increased Fines:* Fines for overstaying a visa will be set at $300 per month to deter abuse of perpetual tourist status.

➡️*Re-entry Prohibition:* Tourists who overstay will encounter a 90-day ban on re-entering the country in the same status, highlighting the necessity of following immigration laws.

➡️*Recommendations:* Foreigners planning to reside in Costa Rica should apply for legal residency and consult qualified immigration lawyers before making property purchases.

➡️*Legislative Modifications:* Proposed changes to current laws include higher fines for irregular stays and a clear re-entry prohibition, aiming to protect Costa Rican socioeconomic interests.

Hello there, dear community! 🙏🏼🇨🇷

I wanted to address some important points regarding a recently published photo that has been reported as modified by AI. This raises valid questions about authenticity and the potential for sensationalism in the media.

As we engage in discussions about travel and residency in countries like Costa Rica, the USA, Canada, or anywhere in Europe, it’s crucial for all individuals, including those from abroad, to understand and respect the laws and regulations of the countries they are visiting. This includes being mindful of local customs and the rights of residents.

While we may hope for certain freedoms when exploring new places, it’s essential to recognize that we cannot expect special treatment regarding legal matters or employment opportunities. Each country has its unique values and legal frameworks, and it is our responsibility as visitors to adapt to these laws instead of expecting them to fit our preferences.

Let’s all commit to respecting the rules of each country we choose to live in or visit. Most importantly, let’s prioritize building respectful relationships with locals and ensure that we do not put our families or assets at risk by attempting to navigate around the legal system.

Thank you for being part of this constructive conversation!.

God bless you and your families. 🇨🇷🙏

Respecting the laws and customs of a country is vital for deepening one’s appreciation of its culture and fostering positive engagement with the local community.

Moreover, this journey will enable you to establish your own LLC, open a bank account, invest in property, secure a Costa Rican driver's license, and enjoy access to healthcare services.

HAPPY INDEPENDENCE DAY COSTA RICA! 🇨🇷 🇨🇷

The commemoration of 203 years of independent life in Costa Rica is one of the most colorful and representative celebrations of our civic culture: parades, bands, lanterns, folkloric dances, and typical food. Central America's Independence is the commemoration -of the countries of Guatemala, Honduras, El Salvador, Nicaragua and Costa Rica- of the signing of the Act of Independence of Central America on September 15, 1821.

The signing of the document originated the independence from the Spanish government. Unlike the other American countries, with the exception of Panama, the independence of Central America was a relatively peaceful process. Central American independence gained momentum after the French occupation of Spain in 1808, which created political chaos in the Iberian Peninsula that ended with the formation of different popular resistance groups better known as juntas.

A meeting between the colonial authorities, and a junta of notables composed of religious and local leaders, ended on September 15, 1821 with the Spanish rule in the former viceroyalty of Guatemala, which included the current territory of the state of Chiapas (Mexico) and the republics of Guatemala, Honduras, El Salvador, Nicaragua and Costa Rica!
