DIVORCE IN COLOMBIA JUST GOT EASIER WITH NEW 2024 DIVORCE LAW!
To all expats and foreigners living in Colombia: If you are feeling trapped in a marriage because your Colombian spouse refuses to sign the divorce papers, the law has officially changed. For years, getting a divorce in the Colombian legal system as a foreigner was a massive headache. Unless you had mutual consent, you were forced into a lengthy, expensive court battle where you had to literally prove "fault" (like infidelity or abandonment) just to get the judge to dissolve the marriage.
That is no longer the case. ⚖️
Thanks to the recently passed Unilateral Divorce Law, getting a divorce in Colombia is now much easier, faster, and entirely in your control.
What does this new law mean for you as an expat?
🛑 No Consent Needed: You can now file for divorce based on your "sole will." If you want out of the marriage, you can legally end it—even if your Colombian spouse completely refuses to agree or sign anything.
🤐 No "Fault" Required: You no longer need to hire private investigators or air out your dirty laundry in a Colombian court to prove someone did something wrong.
⏱️ Less Court Time: Bypassing the fight for consent means you spend significantly less time tied up in the Colombian justice system, allowing you to untangle your life and finances much faster.
Navigating a cross-border marriage is complicated, and ending one is even harder when dealing with foreign assets, visas, or international custody. But actually securing the divorce decree? That just got a lot simpler.
We’ve put together a complete, easy-to-read guide in English on exactly how this new law works and the step-by-step process to file for a unilateral divorce in Colombia today.
