China's copyright law to be revised

Recently, the 23rd Meeting of the Standing Committee of the 13th National People's Congress voted to amend the copyright law.

The revised copyright law includes 6 chapters and 67 articles, which shall come into force on June 1st, 2021.

The main part and direction that has been changed include the following:

1、 The system of punitive damages has been added that the upper limit of legal compensation has been raised to ￥5 million yuan(RMB), and the lower limit of legal compensation has been specified as ￥500 yuan（RMB）.
2、 Revise the regulation of audio-visual works, and change a cinematographic work or a work created by virtue of the analogous method of film production into audio-visual works.
3、 Reasonably expand of broadcasting rights.
4、 Modify the definition of works and the object types of works is unlimited.
5、 Revise the copyright ownership of cooperative works.
6、 Stipulate the ownership of the rights of performing in official duties.
7、 The copyright collective management organization is defined clearly as a non-profit legal person which should be managed standardizedly and whose information should be released to the public.
8、 Take great consideration on the special care for people with dyslexia

WTOIP's consulting services won the fund amount of ￥200 million RMB

In the first ten months of 2020, WTOIP helped clients to apply for the funds with the amount up to ￥200 million yuan. The funds range from the identification of high-tech enterprises, support funds for the industrial product quality improvement to the innovation and entrepreneurship competition fund.

The project launched on December 1st, 2020.

Chinese patent applicants are able to choose the European Patent Office as the international search unit. The State Intellectual Property Office of China and the European Patent Office will launch a two-year pilot project. Under the project, nationals and residents of the people's Republic of China are able to select the European Patent Office as the international search unit for patent international applications submitted in English under the Patent Cooperation Treaty (PCT).

Based on the total number of applications submitted to the National Intellectual Property Office of the people's Republic of China, the maximum number will hit 2500 in the first year, and 3000 for the next year.

WTOIP helped to tackle cold chain logistics problems with solutions from Australia

A logistics company in Shanghai consulted WTOIP that they had got stuck in transporting the seafood. They could do well in areas from coastal districts to short-distance places such as Kunming and Nanning, but failed to transport products in inland areas such as Guizhou, Chongqing and Sichuan, where they are facing the problems of low survival rate of seafood and low transportation density. They hoped to find out tech solutions with the world networks from WTOIP.

PMO team in WTOIP searched over 200 tech corporate partners and finally, received 10 more solutions from countries such as Japan, Israeli and Australia. After the evaluation of all alternatives and a three-month test, the Australian solution stood out and was accepted by the client. Both of the parties now work in close cooperation with each other.

MISSION ACHIEVED: WTOIP MANAGED TO REGISTER A TRADEMARK IN 56 COUNTRIES FOR THE CLIENT

As Chinese enterprises develop to go abroad and pretty much care about the protection of intellectual property rights, those companies begin to seek ways to protect their brands overseas.

The New Patent Law of the People's Republic of China

China's new patent law was passed at the 22nd Meeting of the 13th National People's Congress Standing Committee on October 17th , 2020, and will come into force on June 1st , 2021.

On June 28th , 2020, the 20th meeting of the 13th Standing Committee of the National People's Congress deliberated on the amendment to the patent law of the people's Republic of China (Draft for the second review) and published it on the website of the people's Congress of China. Among them, opinions and suggestions raised by WTOIP have been adopted by reference.

The biggest change of China’s new patent law is that the maximum compensation for patent infringement is FIVE MILLION YUAN (approximately $748,000.00 USD), and the maximum penalty compensation is 5 times. When the base number cannot be determined, the patent authorization income base shall prevail (this is the most severe, which means that there is no upper limit in principle). The date of October 17th 2020 must be a historic moment, and the new patent law will affect all related businesses and people in China.

Guangdong-Hong Kong-Macao Greater Bay Area Intellectual Property Trade Expo 2020 will be held from Oct. 28th to Nov.3rd in a way of online expo.

WTOIP will be the co-organizer and one of the top exhibitors to support the EXPO with professional intellectual property services.

From 2017 to 2019, with an aim of creating an international intellectual property expo that never ends, Guangdong has been consecutively organizing three intellectual property transaction expositions, through which the intellectual property companies based in the Greater Bay Area are to connect with one another focusing on the intellectual property business, to commercialize intellectual property by transaction and operation, and ultimately, to establish a highly proficient operational service system of intellectual property with the cohesion and cooperation.

WTOIP SHOWED UP IN GBC AS CHINA’S GATEWAY FOR SOUTH KOREAN COMPANIES

This is the fourth time that WTOIP shows up in VR/AR Festival in South Korea. This year, WTOIP was invited to join GBC Korea and meet online with top AR/VR companies in South Korea during Oct. 22nd to Oct. 23rd .

Ministry of Science and ICT/ National IT Industry Promotion Agency are hosting “Global Business Creation” to promote exporting and investment VR/AR business with overseas buyers and investors.

This business meeting, with the participation of buyers and investors in the VR/AR industry, will have business matching on Online. Also it creates global business opportunities between South Korea AR/VR companies and overseas buyers or investors through project agreement and investment.

South Korean Chapter of IPIEC 2020 KICKS OFF

The South Korean chapter of IPIEC GLOBAL 2020 will be held online on Oct.26th and 27th. IPIEC GLOBAL 2020 has started this year since July, that over hundreds of projects and products from all around the world are required to join the contest as to enter the China market.

However, considering the Covid situation, most of the chapter contests will be held online. This year, more than 20 Korean companies ranging from the sectors of digital equipment, semi-conductor, skin care, Eco-farming, to big data platform and so on, selected by Gyeonggi Venture Capital Association and Kyonggi University, will join the contest.

The grand final of IPIEC GLOBAL 2020 will be held on December. As for the main organizer of IPIEC, WTOIP continues the supports for global technovation power by helping to bring the excellent projects and products overseas to China. Relatively, WTOIP will invite investors and top panel of experts to join the chapter event and deliver the business matchmaking for South Korean companies.
