Introduction

Every business entity in Cameroon follows a similar process from its creation to its dissolution. Given the legal nature of the business, such process is more or less an entire legal process as it has interjections of legal regulatory and compliance standards that must be followed.

The entire process of the formation, operation, financing, restructuring to the termination of a business therefore involves legal requirements at given levels. It is therefore important that the business ensures that these regulatory requirements are respected.

ARREST UNDER THE CAMEROON CRIMINAL PROCEDURE CODE.

Arrest as per the provisions of Section 30 of Law No 2005/007 of 27th July 2005 governing the Cameroon criminal procedure Code defines arrest as, the act of apprehending someone for the purpose of bringing him/her before the lawful authority authority stated in the warrant.

The main and general rule governing arrest ensures that anyone carrying out an arrest must be in possession of an arrest warrant, which is an order by the State counsel, requesting a judicial police officer to arrest a defendant, an accused or a convict (N.B they all means different things) and bring him before a particular judicial authority, as per section 18 of the CPC.
An exception to the warrant can also arise in situations where crimes are committed flagrant delicto ( caught in the act of commission or just from commission).
any individual can thus arrest anyone caught commiting a felonious offence or a misdemeanor and take the offender before the State counsel.

As for the procedure of arrest, Section 31of the CPC ensures that, anyone carrying out an arrest must disclose his/her identity, and the reason for such an arrest which most times is always stated in the warrant. They must also allow any person to accompany him/her to the place where the arrested person is to be taken to, if he/she demands so.

Once that is done, they arresting officer shall order the person to follow him, and any refusal can permit the officer to use reasonable force on the person as per Section 310(1) of the CPC.

So let's reflect on the case of Blanche Bailey, it's true there is police brutality everywhere but it is necessary to sensitize the public and the military core on the legal procedures needed in ex*****on of their functions, because ignorance is no excuse before the law.

HOW CAN AN ILLEGITIMATE CHILD BECOME A LEGITIMATE CHILD?

The beauty about the law on issues of legitimacy is that it actually provides for circumstances where an illegitimate child can become a legitimate child.
The circumstances herein can include;
1- LEGITIMATION SUBSEQUEN MATRIMONIUM.

This actually ensures that an illegitimate child who was conceived and put to birth while the parents were not married, can become a legitimate child as a result of thr subsequent marriage between the parents.

The major condition here thus is that if marriage between the parents. So if it happens that the marriage isn't between the parents if the child there can be no accord of legitimacy to the illegitimate child.

In case of this subsequent marriage, the available legal procedures which the parents are supposed to fulfill is that if legal recognition wherein they'll need to go before a competent civil status Registrar and carry out the recognition. This at times is mostly done during the celebration of the marriage.

2- ADOPTION
Life has made things diverse and so does humans too. As a result of different reasons held by different persons, not everyone is in possession of the necessaries to conceive ( mostly biological and personal reasons). But the beauty about the law is that there are situations where these set of persons can have children too through the process of adoption.

An illegitimate child once he/she is adopted becomes a legitimate child to those who have adopted him/her. But this mostly is always on the bases of consent...meaning the consent from the guardians or parents of such a child is the major base for any process of adoption to take place.
This was the situation in the Bénard Fonlon case where Justice Endeley of thr Bamenda High Court held that, any process of adoption without the consent from the competent person will be considered null and void.

HAVE YOU EVER ASKED IF YOU'RE A LEGITIMATE OR AN ILLEGITIMATE CHILD?

The law defines a legitimate child as one born from a union that has been solemnized ( a validly contracted marriage).

Solemnization can be either statutorily i.e before the civil status Registrar ( mayor ). The good thing about our law is that there's also the recognition of the Customary marriage, so traditional weddings ate herein included.

Children born when the parents were legally married are thus legitimate. Even if you were conceived before your parents got married but born after the marriage, you're considered a legitimate child.

WHAT ABOUT ARTIFICIAL CHILDREN?

Generally, children born through artificial means, such as in-vitro fertilized children can only be considered legitimate when the sp*rms were fertilized with the woman heat legally married to.

In case the spermatozoa is taken from a person different from the husband of the woman, then the child is considered illegitimate. This illegitimacy remains in place despite any consent given by the husband.

IMPORTANCE OF POA

The importance of POA is that it acts as an instrument which authorizes or appoint a person to legally act and administer affairs on behalf of another. The parties in a power of attorney are referred to as donor (The parties in a POA who donates the power) and a donee (The party whose power is donated to).

Another importance of POA is that it can be granted by individuals and corporations to an agent to perform functions such as instituting an action in court, managing property, signing documents, receiving rent, etc hence the need for a piece of professional advice in drafting a POA.

TYPES OF POWER OF ATTORNEY

Before we flirt into the procedure for getting a POA, it is essential to know that a POA can either be general or specific. A general POA confers legal authority on another to take an unlimited decision of all activities of the donor whereas a specific POA grants legal authority to an agent for specific matters. Hence interested parties should consider getting professional advice for obtaining POA.
