The only route without a Power of Attorney will be via the Court of Protection to have a Deputy appointed.

Having seen the distress on grieving family members where law firms refuse to step down in an administration of an estate, I fully support the judgment in this High Court case.

There are instances where there are valid reasons to appoint lawyers as executors BUT I have seen many Wills and spoken to many clients who think it is MANDATORY to have a law firm acting as executors. It is not an obligation to have a law firm appointed as executors.

A person making a Will has a CHOICE as to their executors.

A law firm who refused to renounce their executorship on an estate have been ordered to pay £25,000 on legal fees as it loses its case
