L'Institut de Droit international a été fondé le 8 septembre 1873 par onze internationalistes de renom qui avaient décidé de se réunir pour créer une institution indépendante de toute influence gouvernementale, susceptible de contribuer au développement du droit international et d'agir pour qu'il soit appliqué. L'Institut se réunit en principe tous les deux ans pour discuter les travaux des commis
sions scientifiques et adopter des Résolutions de caractère normatif. Ces Résolutions sont portées à la connaissance des autorités gouvernementales, des organisations internationales, de la communauté scientifique. De cette manière, l'Institut s'efforce de souligner les caractéristiques de la lex lata pour en recommander le respect, il s'attache aussi, parfois, à statuer de lege ferenda pour contribuer au développement du droit international. En 1904, l'Institut de Droit international a reçu le Prix Nobel de la Paix, en reconnaissance de son action en faveur de l'arbitrage entre Etats, moyen pacifique de règlement des conflits.

The Institute of International Law was founded on 8 September 1873 by eleven eminent international lawyers as an institution independent of any governmental influence which would be able to contribute to the development of international law and promote its implementation. In principle, the Institute of International Law holds a session every two years to discuss the work of the Scientific Commissions and to adopt Resolutions of a normative character.These Resolutions are then brought to the attention of governmental authorities, international organizations as well as the scientific community. In this way, the Institute seeks to highlight the characteristics of the lex lata in order to promote its respect. Sometimes it make determinations de lege ferenda in order to contribute to the development of international law. In 1904 the Institute of International Law was awarded the Nobel Peace Prize, in recognition of its action in favour of arbitration among States, a peaceful means of settling disputes.
