Despite existing legal standards, child victims with disabilities in Austria, Romania and Serbia often cannot fully participate in criminal proceedings. Their rights too often depend on individual discretion rather than guaranteed support.

ICJ’s new report Left to Discretion: Child Victims with Disabilities in the Criminal Justice Systems in Austria, Romania and Serbia highlights key gaps, including:

▪ lack of accessible, child-friendly information

▪ inadequate communication support

▪ weak or delayed assessments of children’s needs

🔎 It calls for practical, rights-based solutions: better support, trained professionals, and truly inclusive justice systems.

📌 In a submission to the UN Committee on Economic, Social and Cultural Rights (CESCR), the International Commission of Jurists (ICJ) has contributed to the development of the Committee’s draft General Comment on the application of the International Covenant on Economic, Social and Cultural Rights (ICESCR) in situations of armed conflict.

The ICJ emphasizes five key principles:

• The continuous applicability and complementarity of the ICESCR in armed conflict, occupation and post-conflict settings;
• That economic, social and cultural rights (ESCR) violations and abuses may constitute international crimes including war crimes, crimes against humanity and genocide;
• The interdependence and indivisibility of all human rights, including ESCR, in situations of armed conflict;
• That States retain their duties to respect, protect and fulfil ESCR, including minimum core obligations, in armed conflict, occupation and post-conflict settings; and
• The need for transitional justice mechanisms to fully and effectively ensure accountability and redress for Covenant violations.

⚖️ The submission draws on the ICJ’s research and field experience, including work on the impact of armed conflict on economic, social and cultural rights in Nepal and across Africa.
