سپرداری سے کیا مراد ہے؟ پولیس نے گاڑی, موٹرسائیکل کو مال مقدمہ بنا دیا اب واپس لینے کا طریقہ کار کیا ہوگا؟

جب بھی کسی جائیداد منقولہ یعنی کہ Moveable Property جیساکہ موٹر سائیکل، ٹریکٹر، بس، پستول، بندوق، موبائل وغیرہ کی بابت کوئی مقدمہ درج ہوتا ہے یا کسی ملزم کی گرفتاری کے ساتھ اس کی moveable property کو پولیس اپنی حراست میں لے لیتی مثال کے طور پر ایک ڈرائیور گاڑی میں منشیات لیکر جارہا ہے پولیس نے گرفتار کرلیا اور گاڑی بھی قبضے میں لے لی تو پولیس اس جائیداد کو مال مقدمہ کے طور پر اپنے قبضہ میں لے لیتی ہے تاکہ متعلقہ عدالت میں برائے ملاحظہ اس کو پیش کیا جاسکے۔ لیکن مال مقدمہ کو چونکہ حفاظت کے ساتھ نہیں رکھا جاتا اور اس کے نقصان کا خدشہ ہوتا ہے اس لیے متاثرہ شخص یا اس پراپرٹی کا مالک متعلقہ عدالت سے رجوع کرتا ہے مطلب جب پولیس کے قبضے میں وہ پراپرٹی ہو تو متاثرہ شخص یا آخری قابض شخص یا اس گاڑی کا مالک متعلقہ عدالت میں درخواست دیتا ہے جس کو سپرداری کی درخواست بھی کہا جاتا ہے۔ اس درخواست میں یہ موقف اختیار کیا جاتا ہے کہ پولیس کے قبضے میں آپکی گاڑی موٹر-سائیکل یا کچھ بھی ہے پولیس کی کسٹڈی میں اس کی حفاظت نہیں ہو رہی مال خراب ہونے کا اندیشہ ہے لہذا مال مقدمہ میرے سپرد کیا جائے ساتھ ہی اس کا ذکر کیا جاتا ہے کہ میں ضامن دینے کے لیے تیار ہوں اگر بڑی گاڑی یا زیادہ مالیت کا سامان ہے تو عدالت ضمانتی مچلکے طلب کرسکتی ہے۔ اس درخواست کے بعد عدالت متعلقہ پولیس سٹیشن سے رپورٹ طلب کرے گی اور آپکو گاڑی موٹر-سائیکل یا جو بھی مال مقدمہ ہے اس کو آپکے سپرد کردے گی۔ سپرداری میں 2 سے 3 دن میں گاڑی و دیگر مال مقدمہ کی سپرداری ہو جاتی ہے۔

پاکستانی قانون اس سے متعلق کونسا ڈیل کرتا ہے؟

ضابطہ فوجداری کا سیکشن 516A سپرداری قانون سے ہی متعلق ہے اس میں یہی بتایا گیا ہے کہ مال مقدمہ جس کا کیس ابھی عدالت میں چل رہا ہو تو اس صورت میں عدالت خود سے یا کسی کی درخواست پر جو اس مال مقدمہ کا مالک کو یا آخری قابض ہو اس کے حوالے وہ مال کرسکتی ضمانتی مچلکے لیکر یا بغیر ضمانتی مچلکوں کے۔

سپرداری سے متعلق چند اہم کیس لاز
