Before a positive Labour Market Impact Assessment (LMIA) can be issued, the employer must complete several required steps.

The general LMIA steps are:

- Determine whether an LMIA is required.
- Meet recruitment and advertising requirements.
- Offer wages and working conditions that meet program requirements.
- Submit the LMIA application to Employment and Social Development Canada (ESDC).
Processing times vary by stream and by province.

Canada offers several pathways for entrepreneurs and investors who want to establish or expand a business while pursuing permanent residence. Provincial entrepreneur streams, such as the Manitoba Business Investor Stream under the Manitoba Provincial Nominee Program, remain active pathways for qualified applicants.

Eligibility requirements, investment thresholds, and processing times vary by program, and intake rules for some federal and provincial programs have changed in recent years.

Because these programs are subject to frequent updates, we recommend a consultation to confirm which option applies to your specific situation.

Many Canadian businesses rely on foreign talent to fill positions that cannot be staffed locally.

Employer-supported immigration programs allow Canadian employers to hire a foreign national through a formal, government-regulated process.

In most cases, the employer must first obtain a Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada before the foreign worker can apply for a work permit. Some positions qualify for LMIA-exempt categories instead.

This month, we will walk through each stage of this process, from the employer's first application to the worker's path toward permanent residence.

Small errors in a sponsorship application can lead to significant delays. The most common mistakes we see include missing documents, incorrect or outdated forms, weak evidence of the relationship, translation errors in supporting documents, and applying under the wrong sponsorship category.

A complete and accurate application reduces the risk of delay or refusal.

Avoid delays by submitting a complete application. Book your consultation through the link in bio.

Every success story reminds us why this work matters.

"My name is Arlene Ortiz. My husband Carlos and I are enjoying a life in Canada because of Carolina. She believed in us and our relationship together and did her very best to make Immigration believe in us. She did such a thorough submission letter, we were not even interviewed by Immigration. We thank our lucky stars every day that we had Carolina for our lawyer. She did a fantastic job. She is the best. Muchas gracias, Carolina, for all your hard work. We really appreciate it."

Sponsoring an adopted child from another country involves two separate processes: the adoption itself and the immigration application. The immigration process includes a sponsorship application followed by an application for permanent residence. Once the child arrives in Canada as a permanent resident, an application for citizenship can be submitted, though the adoption must be finalized first.

Documentation requirements vary depending on the child's country of origin and the type of adoption process followed.

Divorce does not automatically prevent a parent from sponsoring a child to Canada. Custody arrangements play an important role in these applications. Depending on the circumstances, consent from the other parent or legal guardian may be required, along with supporting documentation such as custody orders or written agreements.

Cases involving shared custody or disputes between parents can introduce additional legal considerations.

On September 9, 2026, Immigration, Refugees and Citizenship Canada announced a new temporary measure allowing certain work permit holders already in Canada to study a short course or program without applying for a separate study permit. The measure took effect on September 4, 2026.

This applies to eligible workers whose valid work permit was issued after their original period of authorization, closing a gap that previously prevented some workers from studying short programs under the existing six-month exemption. The goal is to help temporary workers gain skills, licences, and credentials in sectors such as health care, construction, and the trades.

If IRCC has identified you as eligible, you will receive an email directly and you do not need to submit a separate application. The authorization to study ends on whichever comes first: the expiry of your work permit, the expiry of the public policy, or its revocation. The policy is scheduled to run until December 31, 2027, though the government may end it earlier.

This measure does not extend your work permit, and it does not create a new pathway to permanent residence. If your program is longer than six months, a study permit will generally still be required.
