IMMIGRATION OPTIONS FOR VICTIMS OF FAMILY VIOLENCE

As of February 4, 2025, you can now get a temporary resident permit (TRP) for victims of family violence for at least 12 months. We’ll also be waiving fees not only for the initial TRP, but also for new TRPs, work permits, study permits and biometrics.
You will be protected by a special permit to stay in Canada. It’s called a temporary resident permit (TRP) for victims of family violence. It will give you temporary resident status in Canada so you can escape your situation and think about your next steps.
You can also get this permit for your children if they are in Canada. What you should know: In Canada, you do not have to testify against your abuser to get temporary resident status.
Your first TRP can be issued for at least 12 months. Depending on your situation, you might be able to apply for another TRP at the end of the first period. You don’t have to pay fees for your first TRP, or for a new TRP if you apply for another one. You also don’t have to pay biometrics fees. If you get a family violence TRP, you can get coverage for trauma counselling and health care benefits apply for a fee-exempt work permit or study permit
If someone is threatening or abusing you, get help right away. Please call 9–1–1 or your local police in an emergency.

CONSUMER PROTECTION ACT

2026 New regulation requires explicit consumer CONSENT for RENEWALS and SUBSCRIPTION-BASED SERVICES, essentially treating them as new contracts.

Consumers must be able to cancel automatic renewals at any time, before or after the renewal date, without fees or penalties.
Restrictions on automatic renewals of, and amendments to, consumer agreements will have significant implications for suppliers, particularly those using a subscription sales model.

In Ontario failure to comply with the new automatic renewal obligations may void contractual renewal provisions or any purported automatic renewal of a consumer contract, or both. As a result, it will be critical for suppliers to assess the continued viability of their renewal frameworks.

Ontario caps 2026 rent increase at 2.1%
The 2.1 per cent cap on rent increases applies to approximately 1.4 million rental households covered by Ontario’s Residential Tenancies Act, including tenants living in rented houses, apartments, basement units and condos. Exceptions include units first occupied after November 15, 2018, vacant properties, community housing, long-term care homes, and commercial rentals.

The Canada Border Services Agency (CBSA) has announced that it will end the Remote Area Border Crossing (RABC) program.

The change, set to take effect in September 2026, will replace the permit-based system with a telephone reporting procedure, requiring travelers to check-in with Canadian authorities after entering the country, according to a press release.

As of September 14, 2026, all travellers entering Canada through remote areas of northern Ontario or from the Northwest Angle into southern Manitoba, must report to the CBSA at a port of entry or a designated telephone reporting site.

REVIEW YOUR AUTO INSURANCE POLICY: Before your renewal after July 2026, you must actively choose which optional benefits to add.
As of July 2026, medical, rehabilitation and attendant care benefits will remain mandatory, while all other accident benefits coverage will be optional allowing consumers more flexibility to choose coverage that fits their needs and budgets.

New carbon monoxide laws coming to Ontario

Starting Jan. 1, 2026, updates to the Ontario Fire Code will require additional CO alarms in all residential spaces with potential sources of the deadly gas.
Under the updated Ontario Fire Code:
• Carbon monoxide alarms must be installed on every storey of a dwelling unit.
• In multi-unit residential buildings, CO alarm requirements apply to individual units based on the presence of fuel-burning appliances or attached garages and may also apply to public corridors served by fuel-fired equipment.
• CO alarms may be hardwired, plug-in, or battery operated, as long as they meet recognized safety standards.
• Building owners and landlords are responsible for ensuring alarms are installed and maintained; residents and tenants must report any issues with alarms.

Windsor’s Property Standards by-law has been updated!

By-law 148-2025 (replacing by-law 9-2019) includes important changes designed to make expectations clearer for property owners and to better protect the public.
The updated by-law introduces several important changes aimed at clarifying expectations for property owners and enhancing public safety:
• New Definitions: Adds clearer terms such as Derelict Building, Vacant Building, Neglect, and Stormwater Management System.
• Vacant Buildings: Requirements outline that they must be maintained both inside and out, utilities must remain active, and exterior appearances must be kept in good condition. Boarding is now prohibited.
• Drainage & Lighting: New standards are in place for private stormwater systems, rear yard drains, and exterior lighting.
• Safety Enhancements: Requirements now include duct-type smoke detectors for shared furnaces and minimum ceiling heights for basement living spaces.
• Clearer Enforcement: Rules have been aligned with the Ontario Building Code to support consistent enforcement city-wide.

In an injury claim against Windsor City, the Ontario Superior Court of Justice gave the city permission to amend its statement of defence to add a defence under s. 44(10) of Ontario’s Municipal Act, 2001.

In Hardcastle v. Corporation of the City of Windsor, et al., 2025 ONSC 5610, a single-vehicle accident allegedly occurred at the intersection of 9th Concession Road and County Road 42 in Windsor in May 2019.

The plaintiff claimed negligence on the part of Windsor City and the occupier of the Windsor Airport. He argued that he suffered bodily injury when his vehicle drove through the intersection, entered the airport’s property, and hit a concrete barrier.

The court found that the city was trying to correct its oversight in unjustifiably failing to plead the s. 44(10) defence on time. The court did not consider the proposed amendment scandalous, frivolous, vexatious, or abusive of its process.
