DiCenzo v. Sadeghyar

One missing document. A $121,098 deposit returned. A pre-construction agreement declared not binding — even after closing was missed and the unit resold.

In DiCenzo (Linden Park) Holdings Inc. v. Sadeghyar, 2026 ONSC 1566, Ontario’s Superior Court reminded builders — and buyers — that statutory disclosure isn’t a formality.

Where the Residential Condominium Buyers’ Guide is never delivered, section 73 of the Condominium Act, 1998 means the 10-day cooling-off period never begins. The agreement doesn’t bind. The deposit doesn’t stay.

A signed acknowledgment is not proof of delivery. Estoppel does not rescue a builder from statutory duties. And the Act cannot be contracted out of.

For purchasers: keep every email, courier record, and receipt from your signing.
For builders: your disclosure protocol is your first line of defence.

This summer feels like a turning point for MMA Law.

After years of building this practice from the ground up — one closing, one client, one late night at a time — we’re settling into our new home at 305-10350 Yonge in Richmond Hill. A real space. In the community I’ve been serving from a distance for so long.

And the work ahead is bigger than anything I’ve taken on before. We’re deep into real estate and business files across York Region, Toronto and across the GTA — residential purchases and sales, commercial acquisitions, mortgage and refinancing work, condominium development, and the kinds of transactions that touch every corner of real estate. In addition, multiple estate and probate files, real estate litigation and elder law. Long nights, hundred-page drafts, and a lot of coffee. I love it. Every messy, complicated, high-stakes piece of it.

None of this happens without the people who trusted me early — the first-time buyers who called nervous and hung up feeling heard, the mortgage agents and brokers, real estate agents and brokers, private investors, developers and business owners who took a chance on a small firm, the referring lawyers and friends who kept my name in their circle, the clients who came to us in Russian, in Mandarin, and of course, in English, and let us help them build something real.

Richmond Hill, I’m so grateful to be doing this work here. The best is genuinely ahead.
