COVID-19 RELIEF UPDATE - APRIL 28, 2020

As the COVID-19 continues to cause disruption across Canada’s economic landscape, various levels of Government have rolled out additional measures to assist businesses and individuals.

As part of our ongoing COVID-19 Relief series, Adessky Attorneys has summarized the latest Government measures which may assist you. As always, the situation continues to develop, so we will update you as new information become available.

FEDERAL RELIEF MEASURES UPDATE

CANADA EMERGENCY COMMERCIAL RENT ASSISTANCE (CECRA)

What is it?
The CECRA is a government-backed, forgivable loan offered to Commercial Landlords who agree to lower their Commercial Tenants’ rent by 75% during the period of April, May and June 2020. The government will provide 50% of the pre-reduction rent to qualifying Landlords via their commercial lenders and/or financial institution. Tenants will be expected to pay 25% of the rent due, with Landlords reducing their total received amount by 25%

Who is eligible?
Landlords of any small or medium sized business (including non-profits and charities) if the landlords have entered into a forbearance agreement with tenants who:
1. normally pay less that $50,000 per month in rent;
2. are suffering forced closure or revenue loss of 70%;

There are still a number of details yet to be released. Open questions include: Does it apply to net rental or gross rental? What constitutes the $50,000 per month rent threshold? Can Landlords without mortgages benefit from CECRA? What financial information will be required for eligible small business tenants to show a 70% decrease in pre-COVID-19 revenues? As these details are clarified, we will release further updates.

WAGE SUBSIDY PROGRAMS

Canada Emergency Wage Subsidy (CEWS)

What is it?
CEWS is the Wage Subsidy program launched by the Federal Government last month. They will step in to pay up to 75% of the first $58,700 (up to $847 per week) of any employee's salary, retroactive to March 15th, for a period of 12 week in order to ensure employers can retain their staff through the crisis period.

Who qualifies?
Any operating entity who had a payroll prior to the COVID-19 pandemic including corporations, partnerships, sole proprietorships, not for profits, who has suffered a loss of at least 15% of revenue in March 2020 and 30% in April or May 2020 qualifies for this program. An employer need only qualify in any of the three reference periods to enter and remain in the program.

Temporary Wage Subsidy (DAS Remittance Reduction)
What is it?
A program to reduce payroll Deductions at Source remittances to the CRA. The Remittance Reduction is of up to 10% of any employee’s gross pay from March 18-June 19, 2020, (to a maximum reduction of $1,375 for each eligible employee and to a maximum reduction of $25,000 per employer).

Who qualifies?
Any operating entity who had a payroll prior to the COVID-19 pandemic including corporations, partnerships, sole proprietorships, not for profits

STUDENT PROGRAMS

Canada Emergency Student Benefit (CESB)

What is it?
The CESB will provide $1,250 per month for eligible students from May through August 2020, and $1,750 for students with dependents and those with permanent disabilities.

Who qualifies?
Post-secondary students and recent graduates who are ineligible for the Canada Emergency Response Benefit or for Employment Insurance, but who are unable to find full-time employment or are unable to work due to COVID-19.

Information regarding applications hasn’t been announced yet, but the CESB will be delivered by CRA. More details to come.

Canada Student Service Grant (CSSG)
What is it?
The CSSG is a new national service initiative to recognize students' significant contributions to the COVID-19 efforts, and provide support through a grant of up to $5,000.

Who qualifies?
Eligibility isn’t clear yet, but it is believed that you will need to be a student returning to full time studies in the Fall, and be willing to work in a community initiative toward COVID-19 relief,

QUEBEC RELIEF MEASURES UPDATE

COVID-19 EMERGENCY MEASURES TO CHANGE SOON

The Quebec Government has been indicating that measures to slowly end the province-wide shut-down of business and social activities may be announced this coming week.

SCHEDULED INCREASE TO MINIMUM WAGE

Quebec’s minimum wage is due to increase to $13.10 per hour on May 1, 2020. Effective that day, any person working at Minimum Wage will be entitled to $13.10 per hour, and anyone making tips (wait staff, etc.) will be entitled to $10.45 per hour.


CITY OF MONTREAL RELIEF MEASURES

What is it?
Emergency assistance for small and medium-sized businesses in the form of loans of up to $50,000, at an interest rate of 3%. No payments of the loan or interest will be due for 6 months, which can be extended for another 6 months. After the no-payment period, loans accrue 3% interest and would be repaid over 36 months.

Who qualifies?
Small and Medium sized businesses operational for at least 1 year, and who are facing financial difficulty due to reduced ability to sell goods or services.

MISE À JOUR DES MESURES DE SECOURS FÉDÉRALES

AIDE D’URGENCE DU CANADA POUR LE LOYER COMMERCIAL (AUCLC)

Qu'est-ce que c'est? L’AUCLC est un programme de prêts subventions offert par le gouvernement aux propriétaires d’immeubles commerciaux qui acceptent de réduire le loyer de leurs locataires commerciaux de 75 % au cours de la période d’avril, mai et juin 2020. Le gouvernement versera 50 % du loyer avant réduction aux locateurs admissibles par l’entremise de leurs prêteurs commerciaux et/ou de leur institution financière. Les locataires devront payer 25 % du loyer dû, les locateurs réduisant leur montant total reçu de 25 %

Qui est admissible? Propriétaires de toute petite ou moyenne entreprise (y compris les organismes sans but lucratif et les organismes de bienfaisance) si les locateurs ont conclu une entente d’abstention avec des locataires qui:

1. paient habituellement moins de 50 000 $ par mois en loyer;

2.souffrent d’une fermeture forcée ou d’une perte de revenus de 70 %;

Il reste encore un certain nombre de détails à publier. Les questions à régler incluent : s’applique-t-elle à la location nette ou à la location brute? Qu’est-ce qui constitue le seuil de loyer de 50 000 $ par mois? Les locateurs sans hypothèque peuvent-ils bénéficier de l’AUCLC? Quels renseignements financiers les locataires des petites entreprises admissibles devront-ils présenter afin de prouver une diminution de 70 % de leurs revenus antérieurs au COVID-19? Au fur et à mesure que ces détails seront précisés, nous publierons d’autres mises à jour.

PROGRAMMES SUBVENTION SALARIALE

Subvention salariale d'urgence du Canada (SSUC)
Qu'est-ce que c'est? Le SSUC est le programme de subventions salariales mis en place par le gouvernement fédéral le mois dernier. Il interviendra pour payer jusqu’à 75 % des premiers 58 700 $ (jusqu’à 847 $ par semaine) du salaire de tout employé, rétroactivement au 15 mars, pour une période de 12 semaines, afin de s’assurer que les employeurs puissent garder leur personnel pendant la période de crise.

Qui est admissible?
Toute entité opérationnelle qui avait une masse salariale avant la pandémie de Covid-19, y compris les sociétés, les sociétés en nom collectif, les entreprise à propriétaire unique, et les entreprises à but non lucratif ayant subi une perte d’au moins 15 % de ses revenus en mars 2020 et de 30 % en avril ou mai 2020, est admissible à ce programme. L’employeur n’a besoin d’être admissible qu’à l’une ou l’autre des trois périodes de référence pour être admissible et y demeurer.

Subvention salariale temporaire (réduction de versements des retenues à la source)

Qu'est-ce que c'est?
Un programme visant à réduire les versements des retenues salariales à la source à l’ARC. La réduction des versements des retenues à la source est de 10 % du salaire brut de tout employé du 18 mars au 19 juin 2020 (jusqu’à concurrence de 1 375 $ pour chaque employé admissible et à une réduction maximale de 25 000 $ par employeur).

Qui est admissible?
Toute entité opérationnelle qui avait une masse salariale avant la pandémie de Covid-19, y compris les sociétés, les sociétés en nom collectif, les entreprise à propriétaire unique, et les entreprises à but non lucratif

PROGRAMMES ÉTUDIANTS

Prestation canadienne d’urgence pour les étudiants (PCUE)

Qu'est-ce que c'est?
La PCUE versera 1 250 $ par mois aux étudiants admissibles de mai à août 2020 et 1 750 $ aux étudiants avec personnes à charge et aux personnes ayant une déficience permanente.

Qui est admissible?
Étudiants aux niveaux postsecondaires et jeunes diplômés qui ne sont pas admissibles à la Prestation canadienne d’urgence ou à l’assurance-emploi, mais qui sont incapables de trouver un emploi à temps plein ou qui sont incapables de travailler en raison du COVID-19.

L’information concernant les demandes n’a pas encore été annoncée, mais la PCUE sera fournie par l’ARC/ Plus de détails à venir.


Bourse canadienne pour le bénévolat étudiant (BCBE)
Qu'est-ce que c'est?

Le BCBE est une nouvelle initiative nationale visant à reconnaître les contributions bénévoles importantes des étudiants aux efforts visant l’éradication de la COVID-19 et à fournir un soutien grâce à une subvention pouvant atteindre 5 000 $

Qui est admissible? L’admissibilité n’est pas encore claire, mais nous croyons que vous devrez être un étudiant qui retournera aux études à temps plein à l’automne, et être prêt à travailler dans le cadre d’une initiative communautaire visant l’éradication de la COVID-19,

MISE À JOUR - QUÉBEC

MESURES D’URGENCE COVID-19 SUJETTES À CHANGER BIENTÔT

Le gouvernement du Québec a indiqué que des mesures visant à mettre lentement fin à la fermeture des activités commerciales et sociales à l’échelle de la province pourraient être annoncées la semaine prochaine.

AUGMENTATION PRÉVUE DU SALAIRE MINIMUM

Le salaire minimum du Québec passera à 13,10 $ l’heure le 1er mai 2020. À compter de cette date, toute personne travaillant au salaire minimum aura droit à 13,10 $ l’heure, et toute personne touchant des pourboires (serveurs/serveuses, etc.) aura droit à 10,45 $ l’heure.

MESURES DE SECOURS DE LA VILLE DE MONTRÉAL

AIDE D’URGENCE AUX PETITES ET MOYENNES ENTREPRISES

Qu'est-ce que c'est?
L’aide d’urgence aux petites et moyennes entreprises se fera sous forme de prêts pouvant atteindre un montant maximal de 50 000 $, à un taux d’intérêt de 3 %. Un moratoire de 6 mois sur le capital et les intérêts s’appliquera et pourra être prolongé pour un autre 6 mois. Après le moratoire de remboursement, les prêts portent intérêt au taux de 3 % et seraient remboursés sur une période de 36 mois.

Qui est admissible?
Les petites et moyennes entreprises opérationnelles depuis au moins un an et qui sont confrontées à des difficultés financières en raison de la capacité réduite de vendre des biens ou des services.

FEDERAL RELIEF MEASURES FOR BUSINESSES

CANADA EMERGENCY BUSINESS ACCOUNT ( )

- Loans of up to $40,000 for eligible businesses-

This Federal program will be providing interest-free loans of up to $40,000 to SMEs and not-for-profits. Designed to help cover operating costs while revenues are temporarily reduced, these government guaranteed loans are interest free until January 1, 2023, and accrue 5% in interest thereafter. If 75% of the loan is paid by December 31, 2022, the balance shall be forgiven.

To qualify, a business must have had a 2019 gross payroll of between $50,000 and $1,000,000, and must have been operating until at least March 2020.

Employers are expected to make their best efforts to top up salaries beyond the government subsidy amount.

LOAN GUARANTEES FOR SMALL AND MEDIUM-SIZED ENTERPRISES

- EDC Loan Guarantee -

This program provides credit and cash flow term loans to small and medium-sized enterprises. Canadian businesses in all sectors that were otherwise financially viable and revenue generating prior to the COVID-19 outbreak are eligible to apply. This money is to be used for operational expenses only.

It allows financial institutions to issue operating credit and cash flow term loans of up to $6.25 million to existing clients, with 80 percent guaranteed by EDC.

- Co-Lending Program -

This program provides term loans for operational and liquidity needs of businesses, which could include interest payments on existing debt. Similar to the EDC program, this program is available to businesses that were financially viable and revenue-generating prior to the COVID-19 outbreak.

The program is divided into three segments to target support to different business sizes:

-- Loans of up to $312,500 to businesses with revenues of less than $1 million.

- - Up to $3.125 million for businesses with revenues between $1 million and $50 million.

-- Up to $6.25 million for businesses with revenues in excess of $50 million.

Loans would be interest-only for the first 12 months, with a 10-year repayment period.

QUEBEC RELIEF MEASURES FOR BUSINESSES

- CONCERTED TEMPORARY ACTION PROGRAM FOR BUSINESSES ( ) -

Applications will be reviewed on a case-by-case basis, according to the business’ circumstances and Investissement Québec’s management practices.

The program is available to all industries that can demonstrate that they are likely to be profitable after the COVID-19 crisis. Businesses must show that they are having temporary cash flow issues arising from a lack of raw material or product supply (goods or services) and/or inability to deliver goods, products or services.

The Quebec Government has also announced a commitment loan guarantees and/or loans of $50,000 or more to support business’ working capital and help them continue operations.

- TRAINING SUBSIDY PROGRAM ( )-

The Quebec Government has announced a program for employee training that will cover up to 100% of salaries (up to $25/hour), trainer/consultant fees (up to $150/hour) and the purchase of training plans for employees.

This program can be combined with the or Temporary Wage Subsidy programs.
