When a commercial landlord defaults on their mortgage, commercial tenants face significant uncertainty regarding their tenancy and lease enforceability. Unlike residential tenancies, commercial leases in Ontario do not automatically bind a lender who takes possession under a power of sale or foreclosure unless the lender consented to the lease or a Subordination, Non-Disturbance, and Attornment (SNDA) agreement is in place. Without an SNDA, a lender enforcing its security may choose not to recognize the lease, leaving tenants vulnerable to eviction or forced renegotiation.

In slip and fall litigation, the true legal battleground is rarely the floor itself, but rather the presence or absence of a rigorous maintenance paper trail. Since the Supreme Court of Canada’s landmark ruling in Waldick v. Malcolm, occupiers have held a strict affirmative duty to keep their premises reasonably safe.

Meeting this legal standard requires far more than simply reacting to hazards after they occur. Liability under the Occupiers' Liability Act hinges on proactive prevention—specifically, whether an occupier had a reasonable, consistent inspection system in place to detect and address hazards before an injury occurred.

Without documented inspection logs and strict adherence to maintenance protocols, defending a personal injury claim becomes exceedingly difficult for commercial property owners and managers.
