The Law society is currently reviewing the decision released on April 29, 2026, in which Chief Justice Skolrood dismissed both claims from the Law Society and TLABC, stating that “I am not satisfied that the new regulatory structure is unconstitutional…"

It is our position that the Act fails to ensure the independence of the legal professions and their regulator, which is a fundamental democratic principle.

During the trial we initiated in October, 2025, the Law Society argued that independence from government is essential to the rule of law, the administration of justice and public confidence in B.C.’s legal system.

“This case was about protecting the ability of lawyers to serve their clients without government intrusion and ensuring that regulation of the profession remains focused on protecting the public interest in the administration of justice. This decision does not change that position,” says Law Society President Thomas L. Spraggs. KC.

The Law Society remains deeply concerned about the Act and we are reviewing the decision to consider next steps, including a possible appeal, as well as how the decision may impact the public and the legal profession.

At Stevenson, Luchies & Legh, we regularly see the hidden risks that can impact homeowners across British Columbia — and buried oil tanks remain one of the most overlooked.

If your home was built between the 1940s and 1970s, there’s a real possibility an old heating oil tank was left underground when the property transitioned to gas or electric. Unfortunately, out of sight does not mean out of risk.

Over time, these tanks corrode. When leaks occur, they can contaminate surrounding soil and groundwater — often resulting in significant remediation costs and complications during real estate transactions.

From a legal and liability standpoint, key concerns include:
• Tanks that were never properly removed or documented
• Potential denial of insurance coverage
• Liability that may extend beyond the current owner

What makes this issue particularly challenging is that there are often no obvious warning signs. In some cases, the only clue may be a small pipe — or nothing visible at all.
