The Canadian Charter of Rights and Freedoms sets out those rights and freedoms that Canadians believe are necessary in a free and democratic society.

The Charter is one part of the Canadian Constitution. The Constitution is a set of laws containing the basic rules about how our country operates.

Law enforcement officials have to operate with these laws even if they are investigating possible criminal activity.

It is important to know your rights as not everyone that is accused of a crime is guilty. Being innocent does not mean you should waive your rights.

There is a also a huge stigma around being investigated or being accused of a crime. In today's "cancel culture" world, individuals are treated as guilty before all facts are known.

This is why it is important that you deal with any accusations immediately. Contacting a defence lawyer even if you have not been charged should always be the first step.

The Supreme Court of Canada issued a decision last month allowing criminal defendants in cases involving assault — including sexual assault — to use a defence known as self-induced extreme intoxication.

Last year, I defended a client who was charged with uttering threats. I met with the client to gain a full understanding of the situation and learned how this situation came about.

The client was an upstanding citizen and did not have a previous criminal record. I knew that I could explain the circumstances of the case and that alternative measures were a possible option for my client. I was able to argue aggressively for my client and was successful. There was a stay of proceedings with alternative measures ordered of community service.

The Delay Argument or the Jordan Decison refers to the Charter of rights and freedoms: section 11(b) – the right to be tried within a reasonable time.

This important freedom was highlighted in a landmark decision that set waves throughout the Criminal Court System in Canada. The case in which this decision was made was R vs Jordan in Regina, Canada.

This set a precedent for hundreds of cases that followed. A precedent is a previous case or legal decision that can be used in similar cases in the future. Since this case was decided by the Supreme Court of Canada, it is legally binding to all cases of similar nature, in any province at any level of court. This means any lower court cases which relate to R. v. Jordan are allowed to cite this case as precedent.
