Many Filipino-Canadian families have property or family matters in both B.C. and the Philippines: a home here, land back home, bank accounts in both places.

When there's a death, a separation or a sale, dealing with two legal systems can be confusing and slow. Planning ahead helps, for example by making sure your will and documents will be recognized where your property is located.

Melissa Remulla Briones, LL.M., CPHR, CIC.C, is a member of the bar in both British Columbia and the Philippines, and understands how the two systems interact.

What does a lawyer actually do when you buy a home in B.C.? Quite a lot behind the scenes:

1. Review your contract of purchase and sale and the key dates
2. Search the title for charges, liens and other registrations
3. Prepare your mortgage documents and meet with you to sign
4. Prepare and file your Property Transfer Tax return, applying any exemptions you qualify for
5. Handle the funds and register the transfer and mortgage at the Land Title Office on completion day
6. Confirm registration so your keys can be released

Buying, selling or refinancing? We'll guide you from accepted offer to keys.

Leases, supplier agreements, service contracts, loan documents. Many people sign contracts they haven't fully read, and only learn what they agreed to when something goes wrong.

Three clauses worth a closer look before you sign:
1. Termination and renewal: can you get out, and does it renew automatically?
2. Liability and indemnity: who pays if something goes wrong, and is there a cap?
3. Personal guarantees: are you putting your own assets on the line for your business?

A review before you sign often costs far less than a dispute afterward. Send us the agreement and we'll tell you what to watch for.

Were you recently let go, and handed a severance offer with a deadline to sign?

Before you sign anything, it helps to know:
β€’ B.C.'s Employment Standards Act sets only the minimum compensation for length of service (up to 8 weeks' pay).
β€’ Unless your employment contract validly limits it, you may be entitled to reasonable notice under the common law, which can be significantly more depending on your age, role, length of service and the job market.
β€’ Signing a release usually means giving up any further claims.

Having your offer and employment contract reviewed before the deadline can make a real difference.

MYTH: "If I die without a will, my spouse automatically gets everything."
FACT: Not necessarily.

In B.C., the Wills, Estates and Succession Act sets out who inherits when there's no will. If you have children, your spouse often receives a set amount plus a share of the rest, and your children receive the remainder. The result depends on your family situation and may not match what you would have wanted. In blended families, the outcome can be even more surprising.

A will lets you decide. We can help you prepare one that fits your family.

Thinking of incorporating your business in B.C.? Registering the company is only the first step.

Before and after you incorporate, think about:
1. Share structure: who owns what, and whether you need different classes of shares.
2. A shareholders' agreement: what happens if a partner wants out, passes away, or you disagree.
3. Your records: B.C. companies must keep corporate records, including a transparency register of significant individuals.
4. Annual reports: every B.C. company files one with the BC Registry each year. Falling behind can eventually lead to the company being dissolved.

We help business owners set up properly from day one, and keep things in order after.

Not married, but living together? In B.C., that can still matter a lot.

Under the Family Law Act, couples who have lived together in a marriage-like relationship for at least two years are treated as spouses for property and debt division. If you separate, family property and family debt are generally shared equally, the same as for married couples.

Two points people often miss:
β€’ The two years are about living together in a marriage-like relationship, not about owning property together.
β€’ There are time limits. A claim to divide property generally has to be started within two years of separation (for unmarried spouses) or of the divorce order (for married spouses).

A cohabitation agreement can set out your own arrangements ahead of time. Read more on our blog: https://northam-law.com/common-law-relationships-and-property-division-in-b-c/

A will only works after you pass away. But what happens if an accident or illness leaves you unable to make decisions while you're still alive?

In B.C., two documents cover this:
β€’ An Enduring Power of Attorney lets someone you trust manage your finances and legal affairs.
β€’ A Representation Agreement lets someone make health care and personal care decisions for you.

Without them, your family may need to go to court, or the Public Guardian and Trustee may become involved, before anyone can act for you. Both documents have to be signed while you still have the mental capacity to make them.

We prepare wills, powers of attorney and representation agreements together, so your plan is complete.
