Teslas are changing the roads in BC - and changing the way ICBC investigates crashes.

When repair costs climb into six figures, coverage disputes become much more aggressive. We’re seeing more cases where ICBC looks for reasons to deny claims entirely, especially involving allegations of reckless driving, misrepresentation, or improper vehicle use.

A recent incident involving a Tesla driver allegedly asleep behind the wheel on Highway 1 is a reminder that “Autopilot” doesn’t remove legal responsibility from the driver.

“Pretty much any modification that you make to your car exhaust system is likely going to be illegal. So if you replace the muffler with one that’s got a different size or number of baffle plates in it… If you widen the opening at the end of the exhaust outlet, that will be illegal. All of these things are prohibited. Anything that basically could increase the noise of the muffler or the exhaust, is prohibited by the motor vehicle act regulations…”

The government must prove every element of the offence — and much of that proof depends on paperwork from the Superintendent of Motor Vehicles that may not always be enough.

It feels like one - but it’s not. An Immediate Roadside Prohibition in BC is administrative, not criminal. No court. No conviction. No criminal record.

But don’t mistake that for minor. The consequences are immediate and serious: licence suspension, fines, vehicle impoundment, and long-term impacts on your driving record.

If you’ve received an IRP, deadlines to challenge it are strict - and the process is technical. Know your rights and act quickly.
