As we have discussed in prior blog posts, injured claimants have a legal duty to mitigate their injuries and losses from motor vehicle accidents. In other words, injured claimants have an obligation and a responsibility to take reasonable steps to minimize their losses such as by following medical advice.

Most commonly, ICBC will raise the issue of mitigation where an injured claimant has not gone to treatment or taken medication as recommended. Less common are situations where ICBC argues that an overweight injured claimant has failed to mitigate by not losing weight after a motor vehicle accident.

ICBC minor injury caps came into effect for all motor vehicle accidents occurring on or after April 1, 2019. If an injury fits the definition of “minor” in the new law passed by the NDP, then compensation is capped or limited to a maximum $5,500.00 for pain and suffering.
