CLEBC is the most respected and most often relied upon source of continuing professional education for British Columbia lawyers and their support staff. Our mandate is to meet the present and future educational needs of the legal profession in British Columbia. Our

goal is to develop an ongoing long-term relationship with every lawyer in the province. Everyone on our staff is eager to hear your comments and suggestions on how we can accomplish this goal. The Continuing Legal Education Society of British Columbia (CLEBC) relies heavily on volunteer contributors from the legal community, who write the publications, present at courses, and act as members of editorial boards for publications. CLEBC’s newest Practice Point, “The 6 Ps of Private Mortgages: A Practical, Analytical Tool to Help Identify Title Fraud in Private Mortgage Transactions,” offers a practical framework for identifying indicators of title fraud during the review of private mortgage transactions.

Prepared by Nicole W. S. Phillips of Stewart Title Guaranty Company, the paper was originally presented at CLEBC’s Advanced Conveyancing Topics for Paralegals and Legal Support Staff.

While developed primarily for private mortgage refinances, “The 6 Ps” can also be adapted to purchases, sales, and institutional mortgage transactions, helping lawyers, notaries, paralegals, and legal support staff strengthen due diligence and better protect their clients.

We’re proud to have this month’s Spotlight shine down on Michelle Casavant, KC, whose career has been shaped by a commitment to legal education, meaningful change, and creating space for difficult conversations.

Now of Casavant Law, Michelle first became involved with CLEBC as a board member in 2018, serving on several committees and contributing to education initiatives.

Her path to law began far from the traditional route. Growing up in a blue-collar home in rural Saskatchewan, Michelle was the first in her extended family to attend university. With support from Indigenous advisors and student communities, along with encouragement from an important mentor, she found her way to law school at UVic. “It’s been a wild and amazing journey ever since,” she says.

After spending much of her career in Aboriginal law, Michelle’s practice has evolved to focus on conflict resolution, workplace investigations, mediation, circle facilitation, professional regulation, and organizational assessments. Today, she finds the greatest reward in “creating opportunities for meaningful dialogue” and helping people move from conflict toward “understanding, accountability, repair, and growth.”

When asked what she would change about the legal community/profession, she states:

“I would like to see greater emphasis on relational skills alongside legal expertise. Lawyers are often called upon to help people during some of the most challenging moments of their lives and careers. Technical legal knowledge is essential, but skills such as listening, empathy, conflict resolution, and cultural humility are equally important. If we develop these skills, we develop capacity to lead better outcomes for clients and healthier professional relationships.”

At CLEBC, Michelle will serve as part of the faculty for the upcoming Resolving Workplace Conflict, which happens October 16, and this year’s Human Rights Law Conference, which takes place November 5 and 6.
