They came to us stranded in their old country. The Canadian government was taking their permanent residency away. With a son whose university enrollment was on hold. With a life in Canada that existed : jobs, plans, a future — and a life in their home country that had been long completed.
Time before, life went in their way and made them fly back to be with a very sick beloved person. And stay there longer which they did.
They came to us with something that was, by any honest measure, not an promise of a win.
The rule is universal: permanent residents must spend sufficient time in Canada to keep their status. Everyone knows the rule. What not everyone knows is how to argue the exceptions. And they were the exception.
We appealed the decision to cancel their permanent resident status.
The case hearing was extended twice due to insufficient time to hear all witnesses and arguments and lasted for three full days.
And then came the part that no counsel can shorten. The waiting. Waiting. Waiting.
Until a positive decision came. The ruling was to restore the status and return the family to Canada 👍
