If you are renting out a house, apartment or basement, you should consult about the lease agreement. In Ontario, a standard form of contract is used, but it can be supplemented within the limits of the law. The consultation will help you better understand your rights and obligations and avoid possible misunderstandings in the future (for example, eviction of unwanted tenants).

Getting charged with a handheld communication device offence under the Ontario Highway Traffic Act (HTA) can carry serious consequences. Residential Lease Agreements and RTA Compliance in Ontario.

Preparing and reviewing residential lease agreements requires careful attention to Ontario’s Residential Tenancies Act, 2006 (RTA). Improper drafting or reliance on unenforceable terms can expose both landlords and tenants to disputes, fines, and unnecessary legal risk.

We assist clients with the drafting, review, and analysis of residential lease agreements, as well as related documents, to ensure compliance with the RTA and to protect their legal interests.

In Ontario, the Residential Tenancy Agreement (Standard Form of Lease) is mandatory for most private residential tenancies entered into on or after April 30, 2018. The standard lease establishes the core rights and obligations of landlords and tenants under the RTA. These statutory rights cannot be waived, restricted, or overridden, even by mutual agreement.

While the standard lease must be used, it may be accompanied by additional lawful terms, provided they do not conflict with the RTA or the mandatory provisions of the standard form. Any clause that contradicts the RTA is void and unenforceable.

Permissible additional terms may include, for example:

🖊️Smoking policies;

🖊️Rules addressing pest prevention and cleanliness obligations (within legal limits);

🖊️Guest conduct and reasonable noise rules;

🖊️Parking rules and conditions;

🖊️Maintenance and use obligations consistent with the RTA;

🖊️Utility responsibilities and contact arrangements.

These additional terms must be carefully drafted to ensure they are clear, lawful, and enforceable.

We help landlords and tenants properly structure lease agreements within the framework of the RTA, reducing the risk of violations, disputes before the Landlord and Tenant Board, and issues related to unlawful occupancy or unenforceable clauses.

Bill 60, which has sparked significant public debate and protests in Ontario, was signed into law and received Royal Assent on November 27, 2025. Bill 60 shifts the balance of rental regulations in favor of Landlords, reducing the protections for Tenants.

What does this change for Tenants?

1) Less time to pay your rent.

Once you are in arrears, the Landlord can serve you with an eviction notice within 7 days (previously it was 14 days). Other eviction rules remain unchanged.

2) Limitations on Tenant complaints about living conditions.

If a Tenant is late paying due to real problems with the accommodation (mould, lack of repairs, unsafe conditions, etc.), in order for the LTB (Landlord and Tenant Board) to consider their claims, they must now pay at least 50% of their arrears before filing an application.

3) The Tribunal’s powers to take into account individual life circumstances have been reduced.

The Tribunal will be limited by new protocol frameworks. This reduces the ability to take into account complex situations such as job loss or illness.

4) Evictions based on personal use of the accommodation have been made easier.

If the Landlord gives you 120 days’ notice and the date of termination of the tenancy falls within the end of the contract, he/she may NOT pay compensation or offer alternative accommodation.

5) One of the most serious changes: the automatic transition of the contract after the end of the term to a month-to-month lease may be canceled.

6) Reduction of the deadline for appealing decisions.
An appeal against the Tribunal's decision can now be filed within 15 days instead of 30. Against the background of other changes, this is less noticeable, but it also narrows the rights of Tenants.

Bill 60 is already causing serious concern among lawyers and organizations that protect the rights of Tenants in Ontario. It is important to know your rights and not delay in case of dubious or unfair situations with the Landlord.

🙂 Is this good news?
Speed ​​cameras had a serious drawback in that they were almost impossible to successfully challenge. But since they were not personal fines, they had no effect on the driver’s record, so a “pay and forget” solution was the best option.

Today’s decision by the Ford government will change that. The main argument is the predicted deterioration in road safety. No one in the government wants high-profile cases with victims or a sharp increase in the number of accidents, so alternative measures will be implemented. I predict that from Friday, November 14, the number of police patrols on the roads will increase significantly, focused on speeding. Keep an eye on your speedometer!

🚔 What if you do get caught?
The “pay and forget” option is the worst option in this case. This is a personal ticket, so the insurance company will increase your monthly payment by at least 30% (first violation) for up to 3-4 years or by 60-70% after subsequent tickets. You can calculate how much you will lose in three years yourself.

💼Sometimes people advise on social networks to “appeal yourself, the police officer will not come to court and everything will be canceled”, I assure you - this is also a so-so option.
First, the fact that the police officer did not appear does not guarantee that you will win the ticket, because Ontario courts have begun to accept “certified evidences” at the request of prosecutors, i.e. accept the ticket as a police officer’s testimony.

🤝Secondly, a traffic ticket can be canceled for many procedural reasons (errors, inconsistency of documentation on the radar, peculiarities of the terrain, traffic, weather, etc.), so hoping for luck that the police officer will not come to court is to deprive yourself of a favorable chance to cancel the ticket with an experienced Paralegal. Drive safe! 👈
