Kim Spencer McPhee is working with a consortium of firms across Canada to consolidate class actions started in various provinces against Hoffmann-La Roche Ltd Hoffmann-La Roche Limitee, F. AG, Roche Holding Ltd., and Hoffmann-La Roche Inc. (collectively, "Hoffmann-La Roche") seeking damages as a result of Hoffmann-La Roche's development, manufacture and sale of Accutane. Accutane was recommended a

nd prescribed for the treatment of severe acne. The Statement of Claim will be amended and Kim Spencer McPhee will bring a motion for the certification of this action as a class proceeding. The Claim alleges that Accutane causes significant risks, including Inflammatory Bowel Disease. The Claim alleges that Hoffmann La-Roche knew of the health risks associated with consuming Accutane, but failed to warn doctors, patients, and regulators, including Health Canada and the FDA, of those risks. Update: On February 9, 2021, the Ontario Superior Court of Justice dismissed the action on consent of the parties. The dismissal followed an evolution in the science since the action commenced that gave rise to considerable uncertainty regarding a causal link between Accutane use and IBD. This in turn also led to the dismissal of Accutane-related litigation in the United States.
