If you are applying under the Spouse or Common-Law Partner in Canada class, you must be living with your partner and have lived together in a conjugal relationship for at least 12 months.

You will need to provide proof of cohabitation, along with all of the other required documents demonstrating your relationship.

If you are applying under the Family Class through an Overseas Spousal Sponsorship, you do not need to be living together at the time of application as long as you previously lived together for 12 consecutive months.

Again, you will have to provide sufficient proof of both cohabitation and an ongoing relationship, along with all the other required documents.

When common-law couples do not live together at the time of application, IRCC will examine the circumstances, assess whether the reasons for living separately make sense, and determine whether the relationship is genuine and continuing, despite the temporary separation pending immigration to Canada.
