You’ve received a refusal on your study permit application and you are asking yourself what are your next steps. Should you re-apply? Should you challenge the decision?

The answer to this question is often specific to your circumstance concerning what information and documentation your provided in support of your application and the reasons for refusal.

For those looking to challenge the decision, a recent Federal Court decision, Akaya v Canada (MCI), 2026 FC 546, provides example of how IRCC can unreasonably refuse a decision, by failing to ask an applicant about credibility concerns prior to making their decision.

Since November 1, 2024, most applicants for a Post-Graduate Work Permit have been required to provide proof of English or French language skills by uploading their test valid test results. However, we regularly hear from individuals who have received refusals on their applications due to the failure to provide these results. The reason for this? There is no clear place to upload these documents in the application portal.

IRCC’s application instructions indicate that this gap is due to system limitations, but this information is not listed within the application portal itself.

Toronto immigration lawyer Joycna Kang, who is a director of the Canadian Immigration Lawyers’ Association, said "many people receiving these letters will believe they must leave the country immediately, and that they have no other recourse available to them."

She said she was concerned that people will be detained by ICE upon re-entering the U.S. “and end up being deported to countries that Canada has actively stopped removals to, in line with our international obligations.

“The fear is that these letters will result in many people who have a genuine fear of persecution falling through the cracks and not having that fear or risk assessed before being removed,” she said in an e-mail.
