The Federal Court of Appeal recently reaffirmed an important principle in tax litigation: even where a taxpayer receives incorrect information from the CRA about their objection rights, that does not create a legal right to appeal where the Income Tax Act prohibits it.

In Siam v. Canada, the Court upheld the dismissal of a taxpayer’s appeal relating to a reassessment issued under s. 152(4.2) of the Income Tax Act, emphasizing the importance of statutory timelines and evidentiary burdens in tax disputes.

⚖️ Key takeaway: Incorrect guidance from the CRA may raise fairness concerns, but it cannot override clear limits set out in tax legislation.

⚠️ Heads up for workers & contractors ⚠️

Hundreds of workers in Nova Scotia are now facing a harsh reality after believing for years their income was non taxable, based on what they say they were told by their employer.

A recent situation involving Arden Professional Client Care highlights a major risk: Workers claim they were informed (even in writing) that their wages were not subject to tax, only to later learn, following a CRA audit that they may, in fact, owe taxes.

What this means for you:
◾Don’t assume income is tax-free without expert confirmation
◾Contractors are responsible for their own taxes
◾Employer documents don’t guarantee tax compliance

Lesson: Always verify your tax obligations, don't rely solely on employer guidance.

Great piece by a great Associate!

Amateur athletes may be entitled to a tax deferral for amounts earned in relation to athletic activity without loss of amateur status, but athletes and sporting organizations ought to be attentive to the relevant factual considerations and legal ambiguity governing "amateur athlete" tax status.

📅The April 30 tax filing deadline is just days away.

Filing your return on time can do more than help you avoid penalties, it may also open the door to important benefits and credits available to Canadians. Programs such as the Canada Child Benefit, Canada Workers Benefit, caregiver and disability credits, home accessibility claims, and training credits could provide meaningful financial support. There may even be uncashed CRA cheques waiting to be claimed.

Don’t leave money on the table this tax season. File on time, review your eligibility, and make the most of the support available.
