It feels like the New Year is very close now. You can sense it in the pace of the days. We all look forward to slowing down, resting, and spending time with people we care about, even though these last days often feel especially full ✨

The past weeks in our office were busy and focused. Our team worked at full capacity, with a full calendar, ongoing conversations, and thoughtful planning for 2026⚖️

Today is the last working day in our office this year. We are closing for the holiday period and will return on January 5, 2026 📅

This break is well deserved. For our team, for our clients, and for our partners. We are taking this time to slow down, to think, and to spend time with our families. To rest, recharge, and return with new energy and a clear head🧭

Buying a home in Ontario should be exciting, not a financial trap.

But if the seller is a non-resident for tax purposes and you overlooks that fact, you could be the one paying 25% of the sale price to the Canada Revenue Agency (CRA).

At MBLAW Professional Corporation, we often see this surprise arise when buyers or their realtors assume that “non-resident” means “not Canadian.” In reality, a seller may have PR status, but still be a non-resident under Canadian tax law. 

The distinction matters because CRA does not go after the seller. It goes after you.

The key protection? A clearance certificate under Section 116 of the Income Tax Act. 

If the seller does not provide it, the buyer’s lawyer must withhold 25% of the sale price. If this is missed, you, as the buyer, may be liable, plus penalties and interest.

The Agreement of Purchase and Sale is more than just a contract, it is the foundation of your real estate deal. Once signed, it becomes a legally binding contract and sets the terms for everything that follows: price, timing, risks, and responsibilities.

MBLAW Professional Corporation invites applications from qualified law students for an articling position beginning in 2025. This is an opportunity to gain practical experience in Ontario residential and commercial real estate law in a structured, professional setting.

The ideal candidate will demonstrate strong legal writing and research abilities, attention to detail, and an interest in real estate practice. The articling student will be involved in file preparation, client communication, title review, and the closing process for property transactions.

Applicants must meet the following criteria:

📚 Enrolled in or graduated from an accredited Canadian law school

🗓️ Eligible to commence articling in 2025

📝 Strong communication and drafting skills

🔍 Ability to manage competing deadlines with professionalism

🏡 Interest or prior exposure to real estate law is considered an asset
