The Supreme Court of Canada has spoken and survivors are being heard. A landmark decision in Ahluwalia v. Ahluwalia has recognized intimate partner violence (IPV) as its own distinct legal wrong, giving survivors a powerful new path to seek compensation for the harm they've endured.
The court awarded Ms. Ahluwalia $100,000 in compensatory and aggravated damages for the new tort of family violence. This is more than a legal milestone. It's a message to survivors that their pain matters and the law is here to protect them. For far too long, the devastating impact of intimate partner violence wasn't fully recognized in civil law. That changes now.
