Child support is the child’s right, not the parent.

As per the BC Family Law Act, a parent for the purposes of child support can be the natural parent of the child, the guardian(s) of the child, and the child’s step-parent.

How is the amount for child support determined?

Child support in BC is calculated using federal guidelines.  Here’s some factors taken into consideration to establish the support amount:

* The paying parent’s annual income
* How many children need support
* Any special or extraordinary expenses (childcare, medical, activities)

Child support can also continue beyond age 19 for children where a child is enrolled in full-time postsecondary education, if the child remains financially dependent on the parents due to specific circumstances, or for children with disabilities or special needs.

Even if both parents agree on an amount, having it formalized in a court order protects both parties.

Few things are more painful than being separated from the people you love, especially when a visa officer refuses a sponsorship application.

Family sponsorship refusals happen more than you might think and they often occur due to reasons that can be legally challenged.

Common grounds we see in sponsorship refusals:

* Relationship questioned without fair assessment

* Insufficient consideration of the best interests of children

* Failure to assess all submitted evidence

* Procedural fairness breaches (no opportunity to respond to concerns)

If your spouse or family member's sponsorship application was refused abroad, we can assist with an appeal before the Immigration Appeal Division (IAD). If your IAD appeal has been dismissed, we can also help you with a judicial review at the Federal Court.

At Walia Law Group, we understand the emotional impact of these cases. Since 2003, we have helped families navigate the most difficult moments in their immigration journeys and will stand in your corner too.

The Supreme Court of Canada has spoken and survivors are being heard. A landmark decision in Ahluwalia v. Ahluwalia has recognized intimate partner violence (IPV) as its own distinct legal wrong, giving survivors a powerful new path to seek compensation for the harm they've endured.

The court awarded Ms. Ahluwalia $100,000 in compensatory and aggravated damages for the new tort of family violence. This is more than a legal milestone. It's a message to survivors that their pain matters and the law is here to protect them. For far too long, the devastating impact of intimate partner violence wasn't fully recognized in civil law. That changes now.

If you or someone you know has been affected by intimate partner violence, there are legal rights and options available in support. Our team is here to listen and guide you in confidence.

What does ‘separation date’ actually mean in BC?  In British Columbia, your separation date is one of the most important dates in your entire family law case.

That date matters more than you may think as it can affect how property is split, debts are divided, how spousal support is calculated, when you may apply for a divorce and can even influence the outcome of custody discussions.

You don’t need a court order to be legally separated. Living apart or even living separately under the same roof can qualify. Some factors considered by the Courts are whether you continue to share a bedroom, your financial arrangements, your social activities, and communication and intent to end the relationship.

Getting your separation date wrong can lead to complications down the road.

If you’re unsure what your separation date is or what it means for your situation, our team can walk you through it in a complimentary and confidential consultation ☎️

Going through a divorce or separation with children involved?

Child support in BC is calculated using federal guidelines and against some beliefs, it’s not a negotiation, and it’s not optional, it is the child’s right.

Here’s what determines the support amount:
* The paying parent’s annual income
* How many children need support
* Any special or extraordinary expenses (childcare, medical, activities)
* Parenting arrangement

Even if both parents agree on an amount, having it formalized in a court order protects both parties.

Our family lawyers are here to help you understand your obligations and what you’re entitled to.

Received a refusal letter for Permanent Residence in Canada?

Whether your application was through Express Entry, Family or Spousal sponsorship (including refusals that may be appealed to the Immigration Appeal Division), or Humanitarian & Compassionate (H&C) grounds - refusal may feel like the opportunity for residency is closing on you. This refusal situation doesn’t have to be the final outcome.

Common reasons PR applications are refused include:

• Misinterpretation of eligibility criteria
• Procedural fairness issues
• Incorrect application of the law
• Failure to properly consider supporting evidence

At Walia Law Group, we carefully review refusal letters to identify whether the decision-maker made a reviewable error. If they did, we ready your case for a Federal Court Judicial Review.
We have been representing PR applicants since 2003 and we understand the overall impact for each individual.

Time is critical in these instances as you have 15 days (if refused inside Canada) or 60 days (from outside Canada) to file for leave and Judicial Review.
