Child support is the child’s right, not the parent.

As per the BC Family Law Act, a parent for the purposes of child support can be the natural parent of the child, the guardian(s) of the child, and the child’s step-parent.

How is the amount for child support determined?

Child support in BC is calculated using federal guidelines.  Here’s some factors taken into consideration to establish the support amount:

* The paying parent’s annual income
* How many children need support
* Any special or extraordinary expenses (childcare, medical, activities)

Child support can also continue beyond age 19 for children where a child is enrolled in full-time postsecondary education, if the child remains financially dependent on the parents due to specific circumstances, or for children with disabilities or special needs. 

Even if both parents agree on an amount, having it formalized in a court order protects both parties.

Few things are more painful than being separated from the people you love, especially when a visa officer refuses a sponsorship application.

Family sponsorship refusals happen more than you might think and they often occur due to reasons that can be legally challenged.

Common grounds we see in sponsorship refusals:

* Relationship questioned without fair assessment

* Insufficient consideration of the best interests of children

* Failure to assess all submitted evidence

* Procedural fairness breaches (no opportunity to respond to concerns)

If your spouse or family member's sponsorship application was refused abroad, we can assist with an appeal before the Immigration Appeal Division (IAD). If your IAD appeal has been dismissed, we can also help you with a judicial review at the Federal Court.

The Supreme Court of Canada has spoken and survivors are being heard. A landmark decision in Ahluwalia v. Ahluwalia has recognized intimate partner violence (IPV) as its own distinct legal wrong, giving survivors a powerful new path to seek compensation for the harm they've endured.

The court awarded Ms. Ahluwalia $100,000 in compensatory and aggravated damages for the new tort of family violence. This is more than a legal milestone. It's a message to survivors that their pain matters and the law is here to protect them. For far too long, the devastating impact of intimate partner violence wasn't fully recognized in civil law. That changes now.
