The Supreme Court of Canada has spoken and survivors are being heard. A landmark decision in Ahluwalia v. Ahluwalia has recognized intimate partner violence (IPV) as its own distinct legal wrong, giving survivors a powerful new path to seek compensation for the harm they've endured.

The court awarded Ms. Ahluwalia $100,000 in compensatory and aggravated damages for the new tort of family violence. This is more than a legal milestone. It's a message to survivors that their pain matters and the law is here to protect them. For far too long, the devastating impact of intimate partner violence wasn't fully recognized in civil law. That changes now.

What does ‘separation date’ actually mean in BC?  In British Columbia, your separation date is one of the most important dates in your entire family law case.

That date matters more than you may think as it can affect how property is split, debts are divided, how spousal support is calculated, when you may apply for a divorce and can even influence the outcome of custody discussions.

You don’t need a court order to be legally separated. Living apart or even living separately under the same roof can qualify. Some factors considered by the Courts are whether you continue to share a bedroom, your financial arrangements, your social activities, and communication and intent to end the relationship.

Getting your separation date wrong can lead to complications down the road.

Going through a divorce or separation with children involved?

Child support in BC is calculated using federal guidelines and against some beliefs, it’s not a negotiation, and it’s not optional, it is the child’s right.

Here’s what determines the support amount:
* The paying parent’s annual income
* How many children need support
* Any special or extraordinary expenses (childcare, medical, activities)
* Parenting arrangement

Even if both parents agree on an amount, having it formalized in a court order protects both parties.
