🚨 BILL C-12 IS NOW LAW IN CANADA 🇨🇦

Canada has officially brought new immigration and asylum measures into force under Bill C-12. According to IRCC, the law strengthens the system in 4 key areas: new asylum eligibility rules, a modernized asylum process, domestic information sharing, and new authorities over immigration documents and application processing. Some important updates:
✔️ some asylum claims made more than 1 year after first entry into Canada may no longer be referred to the IRB
✔️ some claims made after irregular entry from the U.S. land border and after 14 days may not be referred to the IRB
✔️ IRCC now has new powers, in the public interest, to pause intake, cancel or suspend processing, or change groups of immigration documents like visas, eTAs, work permits, and study permits
✔️ these powers do not apply to refugee protection applications and do not give the government power to grant, change, or revoke immigration status (Canada)

If you have a refugee claim, work permit, study permit, visa, or application in process, this update may affect your options and timing. A 2-year employer-specific work permit tied to your job offer in a participating rural community. You must have a job offer + community recommendation to qualify. 💼🏡 

🔹 Work permit perks:
✅ Work legally while your PR application is in process

🆕 New priority categories:

Sometimes, when no other immigration pathway is available (like work permit, study permit, refugee claim, or family sponsorship), an H&C application is the last and only option to stay in Canada legally.

H&C is case-by-case – IRCC looks at your entire situation. Strong cases usually include:
• Best interests of a child in Canada
• Establishment in Canada (work, community ties)
• Hardship if forced to leave
• Family support in Canada

Canada has updated its Express Entry system to include more healthcare and social service occupations. Newly eligible roles include pharmacists, social workers, dental hygienists, veterinary technicians, cardiology technologists, pharmacy technicians, and more.

If you have at least 6 months of full-time experience in one of these jobs within the last 3 years, you may now qualify for permanent residence.

To check eligibility:
1. Find your NOC code on the Government of Canada’s website.
2. Confirm your job duties match the NOC description.

Important Update: New Unemployment Rates for Low-Wage LMIA Applications – April 4, 2025. On April 4, 2025, ESDC will release the updated unemployment rates. As of September 26, 2024, Low-Wage LMIA applications will not be processed in regions where the unemployment rate is 6% or higher, with limited exceptions (e.g. agriculture, food processing, construction, and healthcare).Employers should review the new rates to confirm eligibility before applying.
